1. My assessment has not changed, why have my property taxes increased?

• There are three major factors that determine your tax bill:
• Assessed value (determined by our office)
• Rollback (determined by the Iowa Department of Revenue)
• Levy rate (determined by local taxing bodies)
• Example of a very simplified version:

$200,000	(assessed value based on market value)
x 0.60	(rollback based on valuation changes throughout Iowa)
$120,000	(taxable value)
x 0.04000	(levy based on budgets of school, county, city, assessor, etc)
$4,800	(tax bill)

The rollback is the same for all properties of that class throughout the state

The taxable value is the value that your taxes are based on

The levy rate is a combination of the tax asking’s of the school, county, city or township, community college, assessor, and other entities whose area your property is located.

3. How does the Assessor determine the value of my property?

Depending on the classification of the property, the assessment is to represent the market value of the property unless otherwise provided by Iowa Code. Residential, agricultural dwellings, multi-residential, commercial, and industrial classed properties are to be assessed at market value. Changes in market value as indicated by research, sales ratio studies and analysis of local conditions as well as economic trends both in and outside the construction industry are used in determining your assessment.  Market value of a property is an estimate of the price that it would sell for on the open market on January 1st of the year of assessment. This is sometimes referred to as the ’arm’s length transaction’ or ’willing buyer/willing seller’ concept. Agricultural land and buildings are valued on productivity and net earning capacity.

4. What is classification?

• Real estate parcels are assigned a property classification by the assessor
• This classification is to be consistent with the primary use of the property
• There are currently five classifications of property in Iowa:
  • Residential
  • Commercial
  • Agricultural
  • Industrial
• Classification may not necessarily be the same as the zoning of the property
• Iowa Code Chapter 441.21

5. How does the Assessor determine Market Value?

• We use Mass Appraisal to determine your value
• We must be at or near market value and have similar properties of a class be equitable
• Our office begins with gathering data on the characteristics of your property
• This is done through an appraiser inspecting your property
• We use the state mandated Iowa Real Property Appraisal Manual to determine the replacement cost new of your building (Cost Approach to Value)
• The replacement cost new is what a property would be worth if it was newly constructed
• The market (sales of other properties) is studied to determine if the property or area needs an adjustment. 
• This is done by using statistical measures specific to that area
• Our approach to value is the Cost Approach adjusted to the Market
• We do not typically use the Income Approach to value, due to difficulty in getting income data from property owners

6. How often is my property reassessed?

• State law requires all properties to be reassessed every odd numbered year.
• If necessary, assessors may reassess property every year.
• Iowa Code Chapter 441.47

7. What do I do if I disagree with the assessed value of my property?

• The first step would be to contact our office to set up a review of your property
• Our assessment date is January 1^st of each year
• From April 2^nd to the 25^th we can come to an Informal Agreement with property owners
• Iowa Code Chapter 441.30
• April 2^nd through April 30^th is also the time frame for filing a Formal Petition to the Board of Review
• The April 30^th deadline may be extended to June 5^th if a disaster has been declared
• If we receive a petition early enough, we will try to turn it into an Informal Agreement
• Iowa Code Chapter 441.31

9. How is the Assessor appointed?

• The local assessor is appointed by a conference board to a six year term after Director of the Department of Revenue approval
• The conference board for the county assessor is comprised of the county supervisors, the mayors of incorporated towns in the county, and a school board member from each school district in the county.
• All assessors must have successfully passed required courses and the assessor exam given by the Department of Revenue.
• Each assessor must successfully complete 150 hours of formal continuing education in order to be eligible for reappointment.

Assessor - Homestead Tax Credit and Exemption

1. What is a Homestead Credit and how do I apply?

• The homestead credit is a property tax credit for residents of the state of Iowa who own and occupy their homestead on July 1 and for at least six months of the calendar year.
• It is a tax credit funded by the State of Iowa for qualifying homeowners and is based on the first $4,850 of actual value of the homestead.
• You can apply for this in person at the Assessor’s Office or online.
• Pre-populated Homestead Tax Credit Application Forms are available to be printed from within your parcel on our website.
• Under "Real Estate Search" enter your property address.
• If you would like to apply online, follow the link after “Submit Application: HOMESTEAD TAX CREDIT”
• If you would like to mail in your application, follow the link included in “please apply for the Homestead Tax Credit”
• This will bring up the Homestead form that needs to be printed, filled out, signed, and returned to our office.

On May 4, 2023, Governor Reynolds signed House File 718, establishing a homestead tax exemption for claimants 65 years of age or older. This new exemption is in addition to the homestead tax credit. With this new tax exemption, eligible claimants who own the home they live in and are 65 years of age or older on or before January 1 of the assessment year are now eligible for a homestead tax exemption. For the assessment year beginning on January 1, 2023, the exemption is for $3,250 of taxable value. For assessment years beginning on or after January 1, 2024, the exemption is for $6,500 of taxable value. An exemption is a reduction in the taxable value of the property rather than a direct reduction in the amount of property tax you pay. 

Applications for this new tax exemption for those 65 and older are available on the Iowa Department of Revenue website or you can apply in person at the Assessor's Office. Cedar Rapids residents should apply at the Cedar Rapids City Assessor's Office. Linn County residents who live outside the city limits of Cedar Rapids should apply at the Linn County Assessor's Office.

The deadline to apply is July 1.

2. What is a Military Exemption and how do I apply?

• The Military Tax Exemption reduces the taxable value of property for military veterans.
• The military service tax exemption is being increased to $4,000 in taxable value for assessment years on or after January 1, 2023. Veterans who are already receiving the military exemption do not need to take any action to receive the increase in the military exemption – the exemption amount will increase automatically. You will see the exemption amount increase on the property taxes that are payable in the fall of 2024 and spring of 2025.
• Veterans who served in active duty and who were honorably discharged are eligible to receive a military exemption on their property taxes.
• If you served in the military and were on active duty for 18 months you are eligible for a military exemption.
• Former and current members of the Iowa National Guard and reserve forces need not have performed active duty if they served at least 20 years.
• Your DD214 must be recorded in Linn County for us to apply this exemption.

Applications for Homestead Tax Credit and Exemptions must be filed or postmarked to your city or county assessor on or before July 1 of the year in which the credit or exemption is first claimed. A claim filed after July 1 of the year for which the person is claiming the credit or exemption shall be considered a claim filed for the following year.

5. Is there an income limitation or requirement to qualify for the 65 and older Homestead Exemption?

No, there is not an income level requirement for the 65+ homestead exemption.

6. If my parcel shows homestead credit as YES, do I need to file the new exemption application for people 65 and older?

7. How long does the Homestead Tax Credit and Exemption last?

An approved Homestead Tax Credit and Exemption claim will remain in effect on that homestead for future years without filing again as long as the person continues to qualify for the homestead credit or exemption.

8. I already receive the Military Homestead Exemption and I am over 65. Do I also qualify for the new over 65 Homestead Tax Exemption?

Yes. Homeowners who are 65 or older AND a qualifying veteran are eligible for both the military exemption and the homestead tax exemption. If you have a spouse who is also over age 65, only one 65 and over homestead exemption is allowed per property.

9. I have applied for the Homestead Credit and/or Military Exemption, but I don't see them on my property tax bill

• Depending on when the homestead credit or military exemption application was received in our office, it may be more than 24 months for the credit or exemption to appear on the property tax statement.
• July 1 is the deadline for filing for the homestead credit or military exemption.
• If the July 1 deadline is missed, the exemption or credit will not be applicable until the next assessment year.
• For example, if a property owner applied for the homestead credit on July 2, 2020, they have missed the July 1 deadline for assessment year 2020. The property owner is now applying for the homestead credit for assessment year 2021. The property owner will not receive a property tax statement reflecting their homestead credit until September 2022/March 2023.

10. What other Credits and Exemption may I be eligible for?

There are several more credits or exemptions that may be applied for at your local assessor’s office or through another office. Each type of exemption or credit has specific criteria and rules. 6. Do I have to show identification at my polling place?

No, it is not required by Iowa law.

The only time a voter is required to show identification is when a voter has become Inactive and decides to vote.

Poll workers may ask for identification to verify your information.

It is helpful to have your ID and Voter's Registration Card ready before you get to the sign in table.

7. When and where are the election results available?

Our office has the lobby typically set up for live results for most elections (i.e. general elections).

There is also a web link where results maybe viewed as they come in.

The election results will not appear until the polls have closed.

8. What and when is the Pre-registration Deadline for voting?

Pre-registering before an election places your name in the Election Register at your polling place and will make for a hassle-free voting experience. If you are not in the Election Register when appearing at your polling place, you must prove your identity and residence before being allowed to vote. This will take time and documentation. It is highly recommended that you register to vote or update your registration prior to the Pre-registration Deadline.

9. If I miss the Pre-registration Deadline, can I still vote?

2. How much does a building permit application cost in Linn County Iowa?

Permit fees are established to offset the cost of administering the building codes including plan review, inspection, inspector vehicles, staff support and record keeping. Building permit fees are calculated based on the valuation of the building or the work (material and labor) involved. In most cases, the building department determines the valuation based on square footage of various components. Calculate permit valuation for a new dwelling for a remodel by entering the square footage for each applicable portion of your project and use the  Building Permit Fee Table to find the permit fee. Permit fees can also be obtained via email or by calling the Building Division at 319-892-5130.

3. Is a building permit required for siding, roofing or replacing windows in Linn County?

Yes. Alterations and repairs require building permits. Certain work is exempt from permits, for example: painting, papering, tiling, carpeting, cabinets, countertops and similar finish work. 4. When are inspections required in Linn County and how do I set up an inspection?

Inspections are required at various stages of work in progress before that work is covered up. Footings require inspection before pouring concrete. Underground electrical, mechanical and plumbing work is inspected before covering. Rough in electrical, mechanical, plumbing and framing must be inspected & approved before covering with insulation or finish material (gypsum board). Inspections are also required on gas piping systems and electrical services.  An approved final inspection is required before the building may be occupied. Note that Linn County inspectors are trained and certified as combination inspectors, which means each inspector is responsible for inspecting all trades. Please view these handouts for further information. Click Schedule an inspection online  or call our office at 319-892-5130 to schedule an inspection by phone.  Allow at least twenty- four hours if you need a specific time for an inspection. Inspection requests made on the same day will be worked in the schedule if possible.

5. What are the building inspectors' hours?

Inspectors hours are Monday -Friday 7:30 a.m. - 4:30 p.m.  Typically, inspectors are in the field performing inspections from 9:00 A.M. until 3:30 P.M. The best time to reach an inspector in the office is 7:30 – 3:30 in the morning and 3:30 - 4:30 in the afternoon. We can, on a case by case basis, do inspections between 7:30 - 9:00 when needed. Unlike some city jurisdictions, Linn County inspectors do not return to the office over the lunch hour due to the driving distances involved in the County. Our office phone number is 319-892-5130.

6. What permits are required to build a house in Linn County?

Separate building, electrical, mechanical and plumbing permits are required. Application for a building permit includes the submittal of electronic .pdf construction drawings. In order to determine a valuation and permit fee, please include the area in square feet for: each floor, finished basement, unfinished basement, garage, decks and porches. Plans are thoroughly reviewed by an inspector for code compliance before issuance of the building permit. Electrical, mechanical and plumbing permits must be obtained and work performed by contractors licensed (Master A) in the respective trade. Further information can be found on our webpage or this handout. Before the above permits can be issued, the Planning & Zoning Division must verify that all zoning requirements are met and must also approve a site plan. Planning and Development staff can assist in creating your site plan, but you will need to be able to provide the location of the proposed structure, distances from lot lines and well and septic drainage field locations. You can apply online or contact the Linn County Planning and Development at 319-892-5130 for alternate means of application. For information on well and septic system permits, contact the Public Health Department , 319-892-6000.  For information on a driveway/entrance permit and addressing permit, contact the Linn County Engineer , 319-892-6400.

7. What is the "farm exemption" and what qualifies for the exemption?

The State of Iowa has given counties the authority to adopt building codes for their unincorporated areas. However, the State has declared that farms should be able to operate relatively free from local restrictions. This "right to farm" is contained in the following section from the Code of Iowa:

331.304.3.b Farms exempt. A county building code shall not apply to farm houses or other farm buildings which are primarily adapted for use for agricultural purposes, while so used or under construction for that use.

Even though the State exempts farms from building regulations, it has provided few guidelines as to what should be considered a farm. In order to qualify under the agricultural exemption, it must be clearly demonstrated that the principal use of the land and the proposed building(s) is farm-related. This includes proposed dwellings, and that the occupants of the dwelling are primarily engaged in agriculture.

We strongly encourage anyone wishing to claim the exemption - especially for a new house - to contact us prior to the start of construction to determine if the exemption is appropriate. The farm exemption applies only to Linn County zoning and building regulations. Other permits (such as floodplain development, well, septic, E911 address or driveway access) may be required. Please contact the appropriate county department for information.

8. What work is exempt from building permits?

Work exempt from building permits may still require zoning approval or flood plain permits. We recommend verifying what is needed for your project prior to beginning any type of work. Email Planning & Development or call 319-892-5130. 

9. What can I do if my permit is expiring and the work is not complete?

If your permit is expiring, you can request an 180 day extension. Your request will be reviewed by an inspector to determine if the permit can be extended or if new permits will be required to complete the project.

You can get a HIV test for free at Linn County Public Health if you have risk factors. If you don't qualify, you can get a test for a fee. Call (319) 892-6093 for more information.

4. Where can I get a tetanus shot?

Linn County Public Health does give tetanus shots.

5. Where can I get a physical for school, sports, camp, etc?

Linn County Public Health does routine physical exams for children age 4 or older for a fee regardless of insurance coverage. Please call (319) 892-6093 for more information or to schedule an appointment.

6. How can I get a copy of my immunization records?

1. What is Community Partnerships for Protecting Children?

Community Partnerships for Protecting Children is an approach that neighborhoods, towns, cities, and states can adopt to improve how children are protected from maltreatment.

It aims to blend the work and expertise of professionals and community members to bolster supports for vulnerable families and children.

Community partnerships is not a program - rather, it is a way of working with families that helps services be more inviting, needs-based, accessible, and relevant.

It incorporates prevention strategies as well as those needed to address maltreatment, once identified.

2. Why are Community Partnerships Necessary?

This new approach to keeping children safe is needed because:

•    Child safety is a 24 hours a day, 7 days a week concern. The Child Protective Services agency cannot do it alone.

•    Services that can help strengthen families need to be made available earlier, before a crisis occurs.

•    Families are more likely to turn to people they know for help rather than to the system.

3. How does the partnership work?

The community partnership approach is based on four fundamental principles:

•    Services for vulnerable families should be individualized to address each child's and each family's specific needs. 

•    Formal and informal supports and services should be available to families through a neighborhood- and community-based network. 

•    The Public Child Protective Services agency should adapt its policies and practices to support the approach, including providing services to families earlier, before crises occur.

1. What is your refund and cancellation policy?

We ask that you call us as soon as possible to inform us of a cancellation. 

We do not provide refunds for cancellations of facility and camping reservations, or for any of our program and shooting range permit registrations.

2. How do I get a campsite at Linn County Conservation campgrounds?

Most all sites are first-come, first serve. 

This includes Wanatee Park Campground’s B Loop, Morgan Creek Park Campground, Pinicon Ridge’s Plains and Flying Squirrel Campgrounds, and Buffalo Creek Campground. Estimated availability of first-come first-serve areas may be found here: First-come First-Serve Campground Availability

There are 24 reservable campsites are in Wanatee Park’s A Loop. All but sites 14, 15, 17,  and 19 have sewer hookup. Reservations must be made online more than 4 days in advance and can be reserved up to 1 year in advance. Once within the 4 days of the arrival date, reservations may not be booked and camping must be done on a first-come, first-serve basis. Reservations are only available online here: Facility/Camping Reservations If no sites appear for the dates you have searched, the reservable A Loop at Wanatee Park is full.

PAYMENT: Our Rules and Regulations for camping state you may only register for your own campsite and that a camping unit (tent, trailer, RV, etc.) MUST be on the site. Coolers, chairs, and vehicles do not count as camping units. Self-register at the kiosk by completing the yellow camping envelope, paying exact fees by cash or check, and dropping that in the fees tube. The tearaway receipt on the envelope flap should be placed on your campsite post. You may pay night by night, or for as many days as you want up to 14 days. You may stay in any one of our parks for 14 out of 21 days before you will required to move to one of our other fine parks. 

Our primitive areas at Wakpicada Natural Area, Matsell Bridge Natural Area, and Mt. Hope are also first-come, first serve and you may self-register onsite. 

3. How long can I camp in a Linn County campground?

You can stay in one Linn CountyConservation campground for a maximum of 14 days out of any 21 day period. After that, we would ask that you move to one of our other campgrounds.

4. What if I need to make a change or cancel my facility or camping reservation?

To change the date of an existing reservation, the request must be made at least three months prior to the reservation date. The new reservation date must be with two years of the date of the change request. A date change can only be made by calling the Conservation Office at (319) 892-6450 and will be assessed a $25 administrative fee. A new reservation would need to be made to change anything other than the date or adding optional amenities (i.e. keg fee).

Please call the Conservation Office at (319) 892-6450 ASAP to inform us of a cancellation. In order to better serve our customers in providing access to our facilities and a high quality experience we do not provide refunds for cancellations. Facilities with canceled reservations will be re-opened for reservation for the date of a cancellation.

5. What if I need to cancel or change my program/event/day camp registration?

Please notify us ASAP if you need to add, cancel or change registrations by calling Wickiup Hill Learning Center at 319-892-6485. No refunds are given for cancellations. The cancelled spot in the program, event, or camp will be re-opened to others if appropriate.  

6. What do I have to do to clean up a facility?

Please note the following when cleaning a facility you’ve reserved:

• All directional signs must be placed on stakes/supports.  They cannot be attached to any park or highway signs/posts.
• The entire floor should be swept - dirt or spills should be mopped up.
• Wipe down all appliances, sinks, counters.
• Make sure all items you brought in are removed from the facility (appliances, cupboards, draws, etc).
• Place tables and chairs on cart and return to storage room.
• Close all windows and doors.
• Shut off ceiling fans.
• Empty refuse containers from restrooms into bags; pick up all outside litter.  Park staff will remove 5 bags of trash. If additional bags are left, there a $2.00/bag charge that will be held from the deposit.
• Shut doors to any fireplaces and let the fire burn itself out (do not use water on the fire).
• Do not throw or use rice, confetti, or bird seed.
• Please having building cleaned and vacated by the appropriate closing time.

County Attorney - Victim Witness Services

1. How do I get a No Contact Order?

The Court automatically issues a No Contact Order in cases involving Domestic Violence, Sexual Abuse, Stalking and Harassment. If you are the victim of some other type of crime the court cannot issue a No Contact Order. However, the Court can issue a Condition of Release, which states the defendant cannot have contact with you.

2. What if charges have not been filed but I would still like a No Contact Order?

Victims can request to have a Civil Order of Protection put in place in situations in which there has been violence or the threat of violence in a domestic relationship or between adult family members that reside together. This can be done at the Civil Clerk of Court’s Office at the Linn County Courthouse.

3. Are my children covered by the No Contact Order in my criminal court case?

No, only the victim is listed as the protected party in the No Contact Order in the criminal case. If you would like to include your children, you must file for a civil Order of Protection through the Linn County Civil Clerk of Court.

4. How do I cancel a No Contact Order if I'm the victim of domestic violence?

First, you must attend the Domestic Abuse meeting at the Linn County Attorney’s Office scheduled for you by law enforcement. If the charge is a simple misdemeanor, you will fill out a form explaining why you would like the No Contact Order canceled and then the attorney will take it to a judge to be approved. If the crime is a serious misdemeanor, aggravated misdemeanor or a felony, you will have to sign a form requesting a hearing to cancel the No Contact Order. You will then have to appear in court on the date of the hearing and the judge will rule if the No Contact Order can be lifted. These hearings are usually scheduled 2 to 3 weeks in the future.

5. What if I'm the victim of sexual assault and I do not want to report it to law enforcement or charges have not been filed and I want a No Contact Order?

Victims of Sexual Abuse can file for a Protection Order through the Linn County Clerk of Court.

6. What if I no longer want to press charges?

Once charges have been filed by the Linn County Attorney’s Office, the State of Iowa is the one "pressing charges," not the victim. The resolution of the case is at the discretion of the attorney assigned to the case.

7. How long does the criminal justice process take?

The process can vary greatly in length of time with the lesser offenses coming to a conclusion within 2 to 4 months and the more serious offenses can take as long as 2 to 3 years.  

8. Why have I not heard anything about the case in which I am a victim?

It is possible that no trial dates or sentencing dates have been scheduled, or we have not received your Victim Packet requesting to be a "registered victim." If you did not receive your Victim Packet or have moved since the case began, please contact the Victim/Witness Coordinator assigned to your case.

9. I have moved out of state. Does this mean the charge will be dropped?

No. Please contact a Victim/Witness Coordinator to discuss the situation and provide your new contact information.

10. Why is the trial date being reset and why is this case taking so long to go to trial?

Unfortunately, a trial date being reset is a common occurrence in the criminal justice system and happens for many different reasons. Factors that can influence how quickly a case is resolved can be as simple as trying to coordinate the schedules of attorneys, witnesses and the Court. If you have questions about the specific case you are involved in please contact the Victim/Witness Coordinator assigned to your case.

11. What is a subpoena?

A subpoena is a court order for a specific date and time that you are required to appear to give testimony regarding a case. 

12. I received a subpoena for a day/time that I have to work. What do I do?

Talk with your employer and show him/her your subpoena. Employers are required to give you time to honor your subpoena by appearing in court, however they are not required to pay you for the time you miss work. If you do not appear, you may be subject to contempt proceedings.

13. What is a deposition?

A deposition is an opportunity for the defense attorney to ask questions of all of the witnesses involved in a case in order to prepare for trial. All depositions are taken under oath, normally in a conference room and with a county attorney present. There is no Judge or jury present for depositions.

14. What types of out-of-pocket expenses can I claim for restitution?

This depends greatly on what the defendant is charged with but in general, you can claim losses directly related to the crime committed. In addition, if you have filed an insurance claim, please include that information on your Victim Restitution Form along with your deductible amount. If you have any questions about restitution please contact the Victim/Witness Coordinator assigned to the case.

15. Can I ask for pain and suffering?

No. In a criminal case a victim is not entitled to receive a monetary amount for pain and suffering. Only out-of-pocket expenses can be reimbursed.

16. If a case has been dismissed or the jury found the defendant not guilty, do I still receive restitution?

Most of the time, restitution cannot be ordered for the victim if the case is dismissed or the defendant is found not guilty.

17. What is a Victim Impact Statement and what should I include?

At the sentencing hearing, victims have the right to make a Victim Impact Statement to the Judge. The statement should be written out and either read by the victim or the Victim/Witness Coordinator. It should include how this crime has affected your life and what changes you have had to make. It should also include what you feel is an appropriate punishment for the defendant. The Victim/Witness Coordinator assigned to your case can help you prepare your Victim Impact Statement.

18. How will I receive my court ordered restitution?

Once the defendant has been sentenced and ordered to pay restitution, they will be required to make monthly payments to the Clerk of Court. The Clerk of Court will then mail the check to you, the victim. If your address changes you will need to contact the Victim/Witness Coordinator to inform them of your new contact information.

19. What do I do if I have not received my court ordered restitution from the defendant?

If the defendant has missed three consecutive payments, they may be subject to a contempt proceeding. You can contact the Victim/Witness Coordinator assigned to the case to inform us you have not received restitution.

5. Do I have to vote according to the party affiliation on my voter registration?

No.

Ballots are secret and voters have the right to vote for any candidate they want.

The only time that party affiliation is important in terms of voting is in the case of a political party caucus or a primary election. In those cases, voters must be registered with the political party whose caucus or primary they wish to participate in. Voters have the right to change their affiliation and then participate in the caucus or primary election on, or prior to, the day those events are being held. Voters can only participate in one party's caucus or primary election each time those events take place.

6. If I miss the Pre-registration Deadline, can I still vote?

While it is highly recommended that you register to vote or update your registration prior to Election Day, you may still register after the Pre-registration Deadline.

8. What types of elections are held in Linn County?

The county has a variety of elections in a four-year cycle. Those elections are: Primary Elections: These elections take place on even number years and the election is countywide. In the state of Iowa, the Primary Elections are “closed primaries” which means a voter wishing to participate will need to declare a party to vote the party’s primary ballot. Typically, there is only the Democratic and Republican Party ballots for the Primary Elections. There have been Primary Elections where additional parties have been added. General Elections: General Elections are held on even number years and the election is countywide. There are two types of General Elections, Presidential General Elections and Gubernatorial Elections. Presidential General Elections are held to elect the President of the United States on the first Tuesday followed by the first Monday in November every four years (2004, 2008 for example). Gubernatorial Elections are held to elect the Governor of Iowa in on the first Tuesday followed by the first Monday in November every four years (2006, 2010 for example). It is common for other Federal, State and County Offices, Township positions, a Judicial Ballot and public measures to be on the General Election ballot. City/School Elections: City/School elections are held in November during odd number years. Depending on the city and the form city government, positions on the city election ballot will vary. Registered voters who reside in the city are allowed to participate in this election. Registered voters who reside in the school district are allowed to participate in this election. Special Elections: Special Elections can be held on specific dates set by the Iowa Secretary of State during a calendar year. Special elections can be used to fill vacancies and to vote on public measures on a State, County, City or School District level. Common special elections in Linn County are Local Option Sales and Services Tax, School Bond and Revenue Purpose Statements and to fill vacancies.

7. Can someone with the power of attorney request an absentee ballot on a voter's behalf?

No. An individual who has power of attorney does not have the authority to sign a voter registration form, request an absentee ballot, or cast an absentee ballot on behalf of the voter. If a voter is unable to sign, the voter can use a stamp or make a mark to sign. The voter may also ask for assistance and have someone sign the form on the voter's behalf as long as it is done in the voter's presence and with the voter's permission.

8. If I need assistance while voting my absentee ballot, can someone assist me?

Yes. If you need help marking your ballot due to a physical disability or inability to read the ballot, you may choose any person to help you except your employer, your employer's agent, or an officer/agent of your union. If you are not physically able to sign the forms, you can use a stamp or make a mark to sign. You may also ask for assistance or have someone sign the form on your behalf as long as it is in your presence and with your permission.

9. What can I do if I make a mistake when voting my ballot?

There are also procedures for "spoiling" mailed absentee ballots that are sent with your absentee ballot. If you make a mistake, place all voting materials in the return envelope. Write “SPOILED BALLOT” on the return envelope. Mail or deliver the envelope to the County Auditor and request a replacement ballot.

10. What should I do if I requested an absentee ballot but I have not received it?

You can see the date your absentee ballot request was processed by our office, the date the office sent your ballot, and the date the office received your voted ballot. 12. If a voter casts an absentee ballot but dies before Election Day, is the ballot counted?

No. Iowa law prohibits these ballots from being counted if our office is notified of the death before absentee ballots are considered.

13. I've heard that absentee ballots are only counted if they will affect the outcome of the election. Is this true?

No. In Iowa, all absentee ballots that are received on time are considered for counting. Absentee ballots received by Election Day are counted on Election Day. Ballots received after Election Day but before the deadline are counted when the absentee and special voters' precinct board meets as long as they are postmarked the day before Election Day or earlier.

2. Do I Need an ID to Register?

No. The Iowa Voter Registration form will ask you to provide your Iowa driver's license number, Iowa non-operator number or the last four digits for your Social Security Number. Please be sure to provide this on the voter registration form so the Linn County Election Services Office can verify your identity. It is best to avoid any problems on election day when you go to cast your ballot!

3. Do I Register at School or Home?

College Students have a choice about where to register to vote. Students must decided between the school or home address for voter registration purposes.

Students attending college in Linn County may register at their school address. You must plan to return after temporary absences, like summer break, but do not have to plan to reside at that address permanently.

Students attending Coe College or Cornell College must include what dorm/building they are residing in. Unfortunately, both college campuses cross precinct boundaries which require additional information like your dorm/building name. This additional information allows our office to place you in the correct precinct and issue the proper ballot.

Registering at Your Home Address

Students may choose to register or remain registered at a permanent address in Iowa or outside the state. In this case, students may need to vote by absentee ballot.

4. What Type of ID Do I Need to Vote?

Iowa voters are required to show ID at the polls before voting. The ID must be one of the following:

6. How Can I Vote?

By Mail:

Iowa allows voters who expect to be away from, or unable to make it to, their polling location on Election Day to vote by mail-in ballot. Voters have to apply for a mail-in ballot.

The absentee ballot deadline is 10 days before a general election, like a Presidential or Gubernatorial Election, and 11 days before other elections. The absentee ballot request form must be in the Auditor's Office by 5 p.m. on the absentee ballot deadline.

Voters may apply for a mail-in ballot at the office starting 120 days before Election Day and ending the Friday before the election. Completed mail-in ballots must be received by the Election Services' office by the close of polls on Election Day, or postmarked by the day before Election Day and received by noon the following Monday.

Elections - Redistricting

1. What date does redistricting take effect?

New precincts and districts, excluding county supervisor districts, in go into place on January 15, 2022 which is written into the Iowa Constitution. 

County Supervisor Districts will be drawn by Legislative Services Agency in late January.

2. Why does redistricting happen?

After each decennial census, districts must be reapportioned for fair and balanced representation. 

 

Federal House Districts, State Senate and House Districts are drawn by Legislative Services Agency and approved by the state congressional body.

 

Precinct boundaries can have no more than 3,500 people when precincts are created.

3. What still needs to be completed?

Precinct plans have been approved by the Secretary of State’s Office.

County Supervisor Districts will be drawn by Legislative Services Agency and approved by the Temporary Redistricting Commission. The Board of Supervisors has the final approve of the supervisor districts.

4. Can I look up the new districts and precincts?

1. How do I register to vote?

You may register in person at our office, by mail, at the IDOT Cedar Rapids driver’s license station or any city hall in Linn County. 

Registrants must complete an Official Iowa Voter Registration form.

2. What is the pre-registration deadline to register to vote?

The pre-registration deadline is 15 days before all elections. After that date, anyone wishing to vote, either absentee or at the polls, must go through the Election Day registration process. This process must be done in-person either at the Auditor’s Office when voting absentee or at the polling location on Election Day. To avoid delays when voting, everyone is strongly encouraged to get registered or update their registration before the preregistration deadline. Voters who are not registered or have moved since the last time voting, may have to vote a provisional ballot if they cannot meet identification requirements at the polls.

3. How do I determine my residence for voter registration purposes?

A residence for voting purposes is where the voter's home is located. A business or any other non-residential property cannot be used for voter registration purposes unless that place is a primary, nighttime residence for the voter. Homeless people are residents of the place where they usually sleep. The voter can only declare one residence for voter registration purposes. There is no restriction on how long a voter has to live somewhere before it can become a residence for voting purposes. The Iowa Code does allow a voter's registration to be challenged for the reason that the voter is not a resident at the address where the voter is registered to vote.

4. I've lost my voter registration card. How do I get it replaced?

Our office can mail a replacement voter registration card to you. Voter registration cards must be mailed. You may not pick up your registration card at the Auditor’s Office. You may request a duplicate voter registration card over the phone (319-892-5300).

5. If I am already registered to vote, do I have to register again before each election?

No. Once you have registered to vote, you do not have to register before each election, unless you move to a new county in Iowa or new State. Voter registration is not transferable across county jurisdictions. If you have moved or changed your name, you must update your voter registration. 6. Can someone with the power of attorney sign a voter registration form on a voter's behalf?

No. An individual who has power of attorney does not have the authority to sign a voter registration form, request an absentee ballot, or cast an absentee ballot on behalf of the voter. If a voter is unable to sign, the voter can use a stamp or make a mark to sign. The voter may also ask for assistance and have someone sign the form on the voter's behalf as long as it is done in the voter's presence and with the voter's permission.

7. Is my voter registration record information considered public information?

Yes. However, your record can only be viewed or obtained by others for specific purposes outlined below. Voter registration records are public records as defined by Chapter 22 of the Code of Iowa. The records must be available for public inspection at reasonable times (§48A.34). Iowa law does not allow for a voter's registration record to be made private. Iowa law allows for the purchase of voter registration lists (See Iowa Code section 48A.38.) Requests can be made at our office. Both the Secretary of State's Office and county auditors are required to maintain a log containing the name, address, and telephone number of every person who receives voter registration information. A voter's Social Security number, driver's license number, non-operator ID number, and the name of an individual agency where a voter registration form was completed are confidential information and are never given to anyone requesting voter lists. Using the information for any commercial purpose is a serious misdemeanor under Iowa law.

8. Can the status of my voter registration change?

Yes. Your voter registration status may change if the County Auditor's Office tried to contact you by mail and the piece of mail was returned undeliverable by the U.S. post office. Also, voter records may be cancelled if the voter no longer meets the qualifications to vote. For more information on voter registration qualifications, see  Voter Registration information.

9. How do I change my address before an election?

Before the end of voter pre-registration:  Linn County registered voters may change their address without any proof of residency. After the end of voter pre-registration (15 days before the election):  Linn County registered voters will need to have proper proof of residency to update their address if it is outside their previous precinct.

The following are acceptable proofs of residence:

• Residential Lease/ College Residency Letter
• Property Tax Statement (current within 45 days of final payment)
• Utility Bill, including cell phone bill

Attester If you cannot prove where you live with the documents listed above, a registered voter from your precinct may attest for you. Both you and the attester will be required to sign an oath swearing the statements being made are true. Falsely attesting or being attested for is registration fraud. It is a class “D” felony and is punishable by a fine of up to $7,500 and up to 5 years in prison Linn County registered voters who move within their precinct do not need to provide proof of residency. The best way to prove residency when making a change of address is with a valid Iowa driver’s license with a current address printed on it.

The cost of the 911 permit is $100.00. You will need an entrance permit on file before a 911 address can be issued. We can check to see if there is a permit on file.

If no entrance permit is on file, you will need to apply for one. The entrance permit costs $50. We will need to know the top surface width of the driveway where it crosses the right of way. Residential driveways can be 16’ – 24’ wide and Commercial driveways can be 16’ – 30’ wide. A technician will go to the property to verify that the driveway conforms to our standards. The permit will be returned to you with any information needed to make the driveway conform. You can apply for the 911 address at the same time and on the same permit. We will need to know the approximate location of the entrance off the county road and where the building will be located.

1. When a road is closed for a project and traffic uses rock roads, how is the dust being controlled?

When a road is closed for a project the Road Department monitors the alternate routes that traffic is taking and obtains traffic counts, both manual and with automated devices, to determine the number of vehicles per day (vpd) on nearby rock roads. If the traffic count is consistently 200 vpd or greater the County will provide calcium chloride dust control.  This approach is consistent with our Fugitive Dust policy.  The calcium chloride is intended to suppress the dust, not eliminate it, in order to create safer driving conditions.

2. Where can I find information about current road construction?

3. How can I receive regular project updates and other project details?

Residents can sign up for project updates through Notify Me on our website. Notify Me will allow you to receive updates by e-mail, text message or both. Updates can also be obtained by calling the Linn County Engineer’s Office at 319-892-6400.

4. What is the difference between Road Closed and Road Closed to Thru Traffic?

Roads may be closed during construction to keep everyone safe or to allow materials to cure before traffic is allowed back on. Drivers not following the road closure signs are putting themselves and the workers in danger. Drivers that do not follow the signing may be ticketed and invoiced for any damage caused.

5. Will vehicle access be available at all times during the concrete paving project?

No, there will be times when access is not possible for local traffic. Local traffic will be allowed on the concrete pavement as soon as maturity is reached (typically within 48hrs.). All residents adjacent to the concrete paving are encouraged to plan travel accordingly during construction. The lack of access is an inconvenience but greatly reduces the amount of time for construction and results in a better product.

6. If access is not available at times throughout the project, how are emergency situations handled?

Emergency services will do all they can to respond to emergency situations. If the shoulder width is not sufficient for access, emergency vehicles will travel on the paved roadway, whether the concrete is mature or not. Concrete can be replaced.

7. How are various services such as mail delivery, garbage pick-up, and bus stops handled during the project?

All affected schools, mail routes, parks, etc. will receive notice of the construction. Affected property owners are required to coordinate individually with each specific service. Property owners adjacent to the paving are required to remove mailboxes during the project.

8. How will my driveway be adjusted to match the proposed concrete overlay?

All (concrete, asphalt, sealcoat, rock, etc.) drives adjacent to the paving will receive a granular taper to allow for the difference in road elevation (approximately 8”) after paving. Additional rock is available for $15/ton (10 ton minimum) if the property owner would like more rock. Property owners can pay to have their paved drives adjusted at a cost of $6/square foot. The cost to adjust a typical driveway is approximately $2,200. The rock placement and paved drive replacement is limited to within the County right-of-way. Please contact the Engineer’s Office if you are interested in having your paved drive replaced.

9. Recently I have seen County crews extending entrance culverts and flattening slopes on driveways and field entrances. How does the County choose which drives to do?

During projects, Linn County gives the adjacent property owners the opportunity to participate in safety improvements. This involves flattening entrance side slopes (6:1 – 6 feet horizontal to every 1 foot vertical) and eliminating headwalls. The flattened side slopes allow errant vehicles to pass over the entrance. The flattened slopes are easier to mow and maintain and allow farm equipment to turn into drives with less risk of sliding into the ditch. The property owner is asked to participate by purchasing the pipe needed to extend to the 6:1 slope. The county will provide the earth to finish the driveway and do rough shaping of the slopes. Please contact the Engineer’s office if you are adjacent to a project and did not receive a letter regarding these safety improvements.

Yes. If you would like someone from the Secondary Road Department to check it, you need a $50.00 non-refundable retain permit. The district foreman will review the seal coat. If the seal coat is in good shape, the permit will allow you to obtain patch material at a County shop through October 31st. If the seal coat is not in good shape, we will contact you so you can sign up for something new.

4. Is the retain permit refundable if my seal coat can not be retained?

No. The permit fee pays for the department to send someone to go to the property and check the condition of the seal coat section. The permit also allows you to pick up patch mix from a county shop to fill potholes within your dust control section.

5. I rent a house on a county road and would like to put dust control down. Can I put dust control down even if I don't own the property?

Yes. You can pay to put dust control on any county road.

6. I want to put dust control in front of my property but it will also be in front of a neighbor's house. Can I do that?

Yes. It is a County road and you can pay to put dust control on any County road you want. What you will want to do is to make sure they don’t pay for dust control for the same portion of the road, as well. If they also want dust control, you can get together and share the cost or lengthen the distance of dust control.

7. Will my dust control still be effective after they blade the road?

Yes. They can blade lightly through chloride and lignin without damaging its effectiveness. We only blade through the dust control if there are holes that need to be filled. Any dust control areas on the road need to be marked so workers know the dust control agent is there when they come through with the blade.

8. Does the County fill gaps between dust control areas?

No, we don't fill the gaps. If you have neighbors that are also getting dust control, you might want to talk to them about distances to ensure there are no gaps.

1. When will my road be plowed?

Roads are plowed based on traffic. Initial efforts focus on roads with higher traffic volumes. These roads are designated as priority routes and are typically destination-based, meaning they provide service between two high traffic destinations. For example, County Home Road between Highway 13 and Interstate 380 is a priority route with a great deal of traffic. Hard surface roads with lower traffic volumes are plowed next, followed by sub-division roads. Gravel roads are plowed between the hours of 7 am and 3:30 pm. We first attempt to open gravel roads to one lane of traffic and then remove the rest of the snow over the following days.

2. What are your hours of operation for winter snow removal?

Linn County's Winter Maintenance Operations Policy (PDF) sets our normal hours of operation at 7 a.m. to 3:30 p.m. Monday through Friday These hours can be extended to 4 a.m. to 6 p.m. and include weekends during snow emergencies. If you have an emergency outside of these hours, dial 911.

Winter Maintenance Operations Policy

3. How do you decide if crews will plow outside of normal hours of operation?

The Operations Superintendent monitors multiple weather forecasting apps, uses the Iowa DOT Road Weather Information System to check air and pavement temperatures, and watches Iowa DOT live cameras to see current conditions when a winter weather event is predicted for Linn County. Then, around 1 a.m., the superintendent drives a two hour route through the whole County in two-wheel drive to get a sense of how difficult it is to get around. If the decision is made to call in crews for extended hours, the superintendent calls the seven managers who call the 30-41 other crew members for an early start time. Mechanics are also called in to be ready for any repair needs.

4. Do you sand and salt gravel roads?

No. Salt and sand are only applied to hard surfaced roads due to the damage it can cause to rock roads. Gravel roads that become slick are roughed up with a motor grader to provide better traction. In some cases, lime, rock chips, sand, or rock is applied to the surface. 

Salt on a gravel road causes maintenance problems as the road begins to thaw out, often making conditions worse. As the salt melts the snow/ice, it causes the salt and water solution to penetrate into the road surface. This causes the road surface to break up and loosens the previously hard packed surface. This process will continue to progress into the base of the road and can create a quicksand like effect. Further damage to the road can occur as vehicles drive over the road because they sink into the road instead of riding across the top. 

5. How long does it take to clear a Secondary Road snow route?

During a Priority Route response, 30 crew members operating 30 truck plows usually take three hours to clear all hard surfaced roads in the secondary road system. During a Standard Route response, 41 crew members operating 30 truck plows and 11 motor graders usually take 10-12 hours to clear all Linn County secondary roads. Response times can vary greatly based upon the weather conditions.

6. The post office will not deliver my mail because of the snow in front of my mailbox. Will the County be out to remove this snow?

No. Property owners are responsible for maintaining access to mailboxes. Mail carriers will not deliver mail if they are unable to reach mail boxes.

7. Why did the snow plow push snow beyond the edge of the road?

We push snow beyond the shoulders to reduce drifting problems and in preparation for the next snow event. Snow that is piled just outside of the traveled portion of the road, including shoulders, is a visual obstruction for motorists entering the roadway from driveways and intersections. Also, snow that is pushed farther back will melt into the ditch and away from the roadway. The county holds right-of-way outside of the traveled portion of the road for the purpose of snow storage and drainage.

8. My mailbox was destroyed by your plow. Are you going to replace it?

Per our policy, Linn County will not repair or replace mailboxes, fences or other private fixtures located in the right-of-way when they are destroyed or damaged during snow removal operations unless such action can be determined to be willful or malicious. 1. How long can I receive assistance?

You must fall within two categories, “ongoing” or “needy”,  to receive assistance and that will determine how long you can receive assistance.

• Ongoing: This category is for individuals who are unable to work because of a disability that can be verified by a medical provider, and are going through the process of applying for Social Security (SSI/ SSDI) and who sign an IAR (see “what is an IAR?” in the FAQs below for more information). If you qualify for this type of assistance, you can receive assistance every month until a determination has been made on your case at which point you are no longer eligible for services. 
• Needy: This category of assistance is for individuals who are in need of temporary assistance and earn less than 30% of the Area Median Income. If you qualify for this type of assistance, you may receive assistance 1 month in a 12 month period.

2. What is an IAR?

IAR stands for Interim Assistance Reimbursement. According to the Social Security Administration, interim assistance reimbursement is a payment SSA makes to reimburse an entity that has provided interim assistance (IA) in cash or through vendor payments to an individual for meeting basic needs. 

Linn County General Assistance requires households to sign an IAR if they are requesting assistance on an ongoing basis.

3. What is United Way 211?

United Way 211 is a free confidential information and referral service, ready to help 24 hours a day, seven days a week. United Way 211 helps connect individual and families to community resources and the services they need, such as utility or rent assistance, food and clothing, counseling, and much more. Just dial 211 or toll free 866-469-2211. From a cell phone or pay phone, please dial 319-739-4211.

4. What is considered earned or unearned income?

If you sold goods or provided labor etc., the money you made is earned income. If you have other sources of income such as child support, FIP benefits, social security benefits, or cash from friends or family etc. that money is unearned income.

5. Students cannot receive assistance. Why is that the case?

The Linn County General Assistance program is assistance of last resort, meaning that we provide assistance when all other avenues of funding have been exhausted. Students enrolled in a technical school, college, university, or other higher education have other resources available to them for assistance often made available through their school’s Office of Financial Aid.

6. How do I enroll for veteran affair medical benefits?

The Linn County Historic Preservation grant application is available online each spring for Linn County non-profit organizations. You must show proof of non-profit status, such as articles of incorporation or an IRS opinion letter establishing tax-exempt status.

Due to legal restrictions, Iowa Code Section 331.901(5), organizations under ecclesiastical or sectarian management are not eligible for Linn County grant funds.

Eligible activities include: projects designed for the purpose of collecting and preserving historical materials, artifacts, places, or structures; maintaining a historical library or collection; conducting historical studies or research; issuing publications; providing public lectures of historical interest; or otherwise disseminating a knowledge of the history of the area to the general public. 2. How long can I expect to wait to be contacted after submitting an application?

The selection process takes a minimum of two to three weeks from the final position closing date. Some hiring supervisors may take several weeks to select applicants for interviews.

1. What age are your residents?

Generally, the residents are ages 12 to turn 18 years old. We have had some as young as nine with extenuating circumstances and juvenile courts approval.

2. My child is out of control, can I bring him/her to detention for the night?

All referrals to detention come from law enforcement or juvenile court. A child has to have broken the law and be deemed a risk to themselves or the community to be considered for acceptance in the detention center.

3. Do you house boys and girls?

Yes, we have both male and female residents. Our population tends to run a third female and two thirds male.

4. What are your visiting policies?

Only parents and legal guardians may visit residents. Parents may bring siblings and grandparents with them. All visitors must have a photo ID. We have set visiting hours. Please call to schedule visits.

5. Can I call a resident of the detention center?

Residents may only take phone calls from their parents or legal guardians. While on the phone with a parent, residents may talk to a sibling or grandparent. Residents are allowed one 5 minute call a day to or from their home.

6. How long does a youth stay in detention?

This all depends on movement in the court system and juvenile court’s plan put in place for the youth. The average stay in detention is around 12 days.

7. How are youth placed in the community based programs?

These programs receive referrals thru the 6th Judicial District Juvenile Court. Staff work closely with juvenile court to aid and assist in all possible needs of the youth and their family.

8. Do you have home visits?

No, there are no home visits for the youth in the detention center. They can only leave the facility via a judge’s order.

9. How do I get a job at the detention center or in one of the community based programs?

All jobs are posted on the county’s website and in the Cedar Rapids gazette. When there is an opening, make sure you meet the qualifications and apply on-line.

1. How do I become eligible to ride LIFTS?

For persons within the Cedar Rapids, Marion and Hiawatha metro areas, Linn County LIFTS is a complimentary paratransit service. This means it is for persons who are unable to ride the public transit system because of a mental or physical disability. To be qualified, you must complete and submit an ADA Paratransit Application. Your application will be processed and a determination will be made as soon as possible.

LIFTS also provides accessible door-to-door public transportation services for senior citizens, people with disabilities and the general public throughout non-metropolitan areas of Linn County. For this service no qualification process is required. Please note – Persons in rural Linn County requesting rides should give as much as a week’s lead time to get their rides scheduled. Call 319-892-5170 if you have questions.  

2. How do I make a reservation to ride LIFTS?

To make a reservation to ride LIFTS, call 319-892-5170, dispatch will be connected. Please call between 7 a.m. and 5 p.m. Reservations can be made up to seven days in advance.

LIFTS will not accept reservations in the form of a phone message, but you can leave us a message to call you back and make a reservation. Individuals should schedule rides at least one day prior to but no more than thirty days in advance of the day they need a ride. LIFTS will provide same-day service if space is available.  

Be prepared to provide the following information when speaking with our staff:

• Any special loading instructions, such as use alley, side door, call ahead, etc.
• Appointment time (if any), or requested time for pick up
• Date riding
• Description of special needs, such as using a wheel chair, type of wheel chair (electric, extra wide, etc.) oxygen tank, service animal, escort, etc.
• Doctor’s name and phone number (if any)
• Drop off address
• Name and contact number of the person requesting the reservation
• Pick up address (include apartment or suite number)
• Your name (rider's name if calling in for someone)

LIFTS staff will then negotiate a pickup time within a two hour window (one hour each way) of your initially requested time. Once a time has been negotiated the bus may arrive 15 minutes before or after this time based on delays or cancellations that occur.

3. How much does it cost to ride LIFTS?

Within the Metro Area:

The basic cost of a one-way ride is $3.00.  Riders must pay when boarding the vehicle.  The correct fare must be paid in cash, tokens, or return ride cards.  Drivers are NOT able to provide change.  Riders who do not have the proper fare will not be transported.

If you need a personal care attendant, (a person or persons necessary for your health care), authorization must be approved by Cedar Rapids Transit.  This will be asked on the eligibility application for LIFTS.  This will allow the attendant(s) to ride for free – please notify the scheduler at the time the ride is requested.  Companions are different than personal care attendants. One (1) companion is eligible to ride with you for the regular fare.                                          

Extra companions (persons traveling with you simply for convenience) are permitted AS AVAILABILITY ALLOWS. Each companion will pay the $3.00 per one-way trip.

Outside the Metro Area::

The cost of a ride outside the metro area is $3.00 one way for senior citizens and disabled.  The cost for general public is $6.00 one way.

Service Animals:

The scheduler needs to know if a Service Animal will accompany you when scheduling the trip.  Service animals are welcome on LIFTS buses.

4. How do I cancel a LIFTS ride?

It is important to cancel your ride as early as possible. By doing this, you make it possible for other riders to get the transportation they need.

Call 319-892-5170; the phone is staffed with an employee Monday through Friday from 7:00 a.m. to 5:00 p.m. There is a voice mail system in place at all times to assist you in directing your call. You may call anytime day or night to cancel a ride. You must cancel at least one hour prior to the ride to avoid a missed ride (see the missed ride policy below).  

If you are calling after hours for a cancellation, please leave the name of the rider, telephone number, date(s) and time(s) of trips you want cancelled. It is also helpful to include the pick-up and drop-off addresses of all the trips you wish to cancel.

Drivers cannot make scheduling changes. Please do not ask them to make any changes for you.  All schedule changes must be done through direct communication with the LIFTS scheduler. Please call for any changes -319-892-5170.

5. Can someone ride along with me on the bus?

In accordance with the U.S. Department of Transportation regulations, "service animal" means any guide dog, signal dog or other animal individually trained to work or perform tasks for an individual with a disability, including, but not limited to, guiding individuals with impaired vision, alerting individuals with impaired hearing to intruders and sounds, pulling a wheelchair, or fetching dropped items.

Your service animal is welcome on LIFTS. No permit is required, but you may be asked to confirm that your animal is a service animal. You are responsible for the care and supervision of your animal while on board.  A service animal should remain on the floor or in a customer's lap, but cannot be given its own seat.  Uncontrolled service animals or service animals which threaten other customers cannot be accommodated.

An animal which solely provides emotional support, well-being, comfort or companionship is not a service animal. These types of animals, "companion animals," are considered pets are not allowed to be transported on LIFTS buses, unless they are in an approved pet carrier.

7. What hours do LIFTS buses run?

In the metro area (Cedar Rapids, Hiawatha, and Marion) service is provided:

• Monday – Friday: 6 a.m. to 6:40 p.m.
• Saturday: 8 a.m. to 5 p.m.

Holidays -  LIFTS is closed New Years Day, Memorial Day, Independence Day,  Labor Day, Thanksgiving, and Christmas. Times may vary for the observed holiday dates, if they differ from the actual holiday.

8. Does LIFTS provide service on the weekends?

LIFTS does provide limited service on Saturdays, but does not provide service on Sundays. Saturday service is generally limited to the Cedar Rapids, Marion and Hiawatha metro areas (no rural/county service).

5. How do I pay for services?

Each individual provider will work with patients on payment for services. A variety of payment options, based on household income, are available for patients seeking help at the Mental Health Access Center.

6. What is it like to use the Mental Health Access Center?

Each patient that comes into our doors will first be seen by a member of Foundation 2's crisis team. This staff member will take basic vitals to make sure no physical medical conditions are present. After vitals, staff will discuss the reason for your visit as well as work through screening tools that help the staff better understand your needs and work towards a successful discharge. These screenings consist of suicide screening, brain injury screening, and basic mental health and substance use disorder screening. Once this process is complete, we will work with you to determine the best level of care. This could be continued work with Foundation 2 or a warm hand off to our other three providers in the building: Abbe Community Health, Penn Center, or Area Substance Abuse Council.     

7. Will anyone know if I received services?

No. All information that you give to us will be held strictly confidential. We cannot divulge any information without a signed release. To have any information shared you will need to complete a release of information form for us.

8. Will you help me with other resources I need?

The Mental Health Access Center is fortunate to have partnerships with many other organizations in the community that can help address other needs besides mental health and substance use disorder. Our first priority will be addressing the immediate needs of the patient, but we will also help patients connect to other resources in the community.  

9. Can I leave on my own?

Yes. Services at the Linn County Mental Health Access Center are 100 percent voluntary. It is not a locked facility and no services will be provided against the will of our patients.

10. Is there a limit to the number of times I can come?

No. Staff at the Linn County Mental Health Access Center understand that mental health and substance use disorder crises can occur throughout a person’s life. Therefore, there is no limit to the number of times an individual can use the services. Each time an individual uses the Mental Health Access Center, staff will address the primary presenting issue and work with the patient for the best plan of action regardless of whether the patient has used the services at a previous time.

11. Why do you take vitals during triage?

Although this may seem like an odd piece of information to collect at a Mental Health Access Center, it is important for staff to assess all aspects of the patient’s well-being and that includes a few physical health assessments. Vitals may not be taken immediately if other assessments are critical to complete at the time. Vitals are also important to our higher-level services such as medical detox and crisis observation. Once a patient is admitted to those services, vitals are taken by nursing staff on an ongoing basis.

12. Can my family or friends visit?

Support systems for those addressing Mental Health and Substance Use Disorder crises is vitally important and in normal circumstances we encourage any loved ones or friends to accompany a patient to the Access Center and stay with the patient while they are in our care. However, due to COVID-19 safety protocols, patients can have one support person accompany them into the Access Center during triage and non-overnight stays. If a patient needs to stay overnight, staff will provide ways to keep patients connected to support systems  via phone calls, FaceTime, or other online means.

13. What COVID-19 protocols are in place?

The COVID-19 pandemic has changed many of the ways we function within medical settings. The Mental Health Access Center also has had to adjust policies and procedures to keep both patients and staff safe. The following COVID-19 safety protocols are in place at the Mental Health Access Center:

• All staff and patients will have temperatures taken upon entry as well as complete the COVID-19 health questionnaire approved by Linn County Public Health.    
• Face masks must be worn at all times while a patient and support member are in the Mental Health Access Center waiting room, triage rooms, counseling offices, crisis observation area, day room area, and restrooms. Masks do NOT need to be worn when in individual bedrooms unless staff or other patients enter. The Mental Health Access Center will provide masks to those who do not have one when entering the building.
• Waiting room area will be cleaned and sanitized multiple times each day. 
• All triage rooms will be cleaned and sanitized after each patient has departed.   
• All bedrooms will be cleaned and sanitized after discharge of patient.
• Staff will try to maintain 6 feet of space when capable.
• At this time, we ask that only one support person comes with each patient into the Mental Health Access Center. If a patient needs to stay with us overnight or for a few days, we will do our best to keep each patient connected to support members via phone calls, FaceTime, or other online means.  
• Signage will be posted throughout the Access Center with COVID-19 precautions.

In the event of bad weather, Linn County will announce on local WMT radio and KCRG-TV9 if Options will be closed. Just because local schools are closed, doesn’t mean Options is closed.

Linn County LIFTS provides transportation for residents in Linn County. Call LIFTS at 892-5170, to check if there is a route near you. LIFTS rides are $3 per ride. LIFTS tokens may be purchased at Options for $60 for 20 tokens. Checks should be made out to LIFTS.

Planning & Development - Dows Farm

1. What is an Agri-Community?

An agri-community is a development built around a working farm – think of a golf course development, only instead of a golf course the central amenity is a farm. Typically, the farm is relatively small, uses farming practices that minimize the impacts on the surrounding development, and welcomes the surrounding residents and neighbors to get to know the farmer and learn about the farm operation.

2. Why did the County buy this land?

The north 306 acres is adjacent to the county-owned Wanatee Park and the City of Cedar Rapids' Gardner Municipal Golf Course. Because of its strategic location adjacent to existing park and recreation facilities, this was the County’s priority for acquisition. The intended long-term use of the 306-acre area is for conservation and related uses.

The south 179 acres, bordered by Mt. Vernon Road on the south, Dows Road on the west, and the Squaw Creek Ridge residential development on the northeast, was included with the purchase and is the project area for the Dows Farm Agri-Community.

3. How much of the site will be protected?

The Dows Farm Agri-Community keeps 75% of the site in conservation open space or agriculture, with only 25% of the site allocated to development of a mix of housing types and a carefully integrated commercial area. Based on feedback from the Phase One Concept Plan, the Phase Two Plan shows a reduction of 100 total dwelling units (from 351 to 251), mostly through a reduction in the number of center hall apartment units.

A maximum of 251 total residential units (1.4 units/acre overall density):

4. Could this property be developed if the County wasn't creating an agri-community?

Yes. The property is designated for urban development on the County’s Future Land Use Map, and can be served by city water and sewer. While there are many factors that would determine a final design, it is possible to estimate with some confidence a range of residential lots developed under a conventional subdivision proposal. 

It is reasonable to estimate a minimum of 106 single-family residential lots at a 1-acre lot size, with up to 85% of the site developed and only 15% in open space as flood hazard area.

In order to reduce the cost per lot of providing city water and sewer, it is also reasonable to assume that lot sizes may be smaller than 1 acre, or that duplexes would be included. Lot sizes ranging from ½ acre down to ¼-acre result in a range of 212 – 424 residential lots. Again, up to 85% of the site would be developed, with only 15% in open space as flood hazard area.

5. How does the density of the Dows Farm Agri-Community compare to the density if the property is developed as a conventional subdivision?

The density is very comparable to what it would be as a conventional subdivision. The table below shows a comparison between the density of the Dows Farm Agri-Community with that of conventional subdivisions of various lot sizes.

6. Has a traffic study been completed for this project?

Yes. Plus, based on feedback from neighbors in response to the Phase 1 Concept Plan, the street design has been revised to eliminate direct access from the development onto Dows Road. The Traffic Impact Study concludes:

• Mt. Vernon Road has excess capacity and can absorb the traffic generated by the project;
• Additional study is required to determine what, if any, traffic controls or calming measures should be implemented at the eastern-most access point with Mt. Vernon Road;
• With the elimination of the direct access onto Dows Road (other than for farm-related services), minimal traffic impact from the project is anticipated to Dows Road or Wanatee Road.

7. Will the County act as the developer?

No. Linn County will issue requests for proposals to developers, and will select a developer (or developers) based on their proposals, or bids, to develop the property in accordance with the Dows Farm Agri-Community guidelines. The design of the buildings, the interspersing of open space within the development, and the relationships between the uses will be carefully governed as part of the development requirements.

8. How long will it take for the Dows Farm Agri-Community to be completed?

That depends on a number of factors, such as how much of the market it will capture, and interest rates. A Residential Market Analysis has been completed. The Residential Market Analysis concludes:

• The Dows Farm Agri-Community is a unique product, which may result in a higher level of demand within a potentially smaller buyer market;
• The low risk/high profit products are likely the single family dwellings on moderate- to small-size lots, and the apartment rentals;
• The project is expected to have at least a 5-6 year buildout.

Planning & Development - Pipeline

1. What is Linn County’s role in the pipeline permitting process?

Iowa Code Chapters 479 and 479B give the Iowa Utilities Board (IUB) authority to oversee the state permitting process for intrastate hazardous liquid or natural gas pipelines. The IUB reviews the location and route of proposed pipelines, and may grant the permit with conditions related to these factors. There are no specific rules as to a pipeline’s location or setback. Both chapters require the IUB to consider the “the relationship of the proposed project to the present and future land use and zoning ordinances. (The Iowa Legislature, 2022, p. 479.6(9) and 479B.5(7))” as the petition for a permit must include this information. While the IUB must consider county zoning and future land use plans, the IUB is not the enforcement authority to ensure zoning and future land use plans are met. This can be interpreted as left to counties. 

2. What is Linn County proposing?

Linn County is proposing an ordinance that is purposefully limited to establishing setbacks for hazardous materials pipelines to protect the health, safety, and welfare of Linn County residents in conformance with the Linn County Comprehensive Plan.

3. Why is Linn County proposing language regulating the placement and construction of hazardous pipelines?

In May 2022, the U.S. Department of Transportation’s Pipeline and Hazardous Materials Safety Administration (PHMSA) announced a new rulemaking for carbon dioxide pipelines, in response to a pipeline failure in Satartia, Mississippi (PHMSA, PHMSA Announces New Safety Measures to Protect Americans From Carbon Dioxide Pipeline Failures After Satartia, MS Leak, 2022). The standards are not yet available from PHMSA.  In the absence of updated standards, Linn County is proposing setbacks based on the best available current knowledge.

Planning & Development - Solar Farms

1. What is a solar farm?

A solar farm, also known as as utility scale solar is defined in Linn County as a group of interconnected solar panels/arrays that convert sunlight into electricity for the primary purpose of wholesale or retail sales of generated electricity. According to the US Energy Information Administration (EIA) most US  utility-scale solar power plants produce between 1-5 megawatts of solar power. However some can generate 50 megawatts or greater. The US currently has more than 2,500 utility- scale solar electricity generating facilities.  

According to the Solar Energy Industries Association (SEIA), “the primary defining characteristic of utility-scale solar projects are that they sell the power they generate directly into the electric grid. What distinguishes utility-scale solar from consumer-scale solar is both project size and the fact that electricity is sold to wholesale utility buyers, not end use consumers.”

2. How does Linn County permit solar farms?

A utility-scale solar project requires an application to rezone the area to be used for the solar installation to (RE) Renewable Energy Overlay Zoning District. The Linn County Planning & Zoning Commission shall hear the rezoning request and will forward a recommendation of approval or denial to the Linn County Board of Supervisors. The Board of Supervisors will hold three public hearings for the rezoning request before making their final decision.  For more information on the permitting, visit our solar farm webpage.  Meeting dates can be found on the Zoning Calendar.

3. What is considered for approval of a solar farm?

Requests to rezone property to an RE (Renewable Energy) overlay zoning district must meet all current rezoning standards for review in Article IV, Section 107-69 of the Unified Development Code, with some exceptions as noted below. These standards for review are evaluated by Linn County Planning & Development staff in a report that is generated prior to the Planning and Zoning Commission meeting. The applicable rezoning standards for review are:

1. The proposed development is not detrimental to existing agricultural uses; 
2. The proposed development will not degrade significant environmental, ecological or natural resources;
3. The proposed development achieves densities and uses in agricultural areas, critical natural resource areas, rural residential development areas and urban service areas as designated in the comprehensive plan; and
4. The proposed development is consistent with the goals, objectives and strategies of the comprehensive plan.

4. What is required for solar farm?

Linn County will require any solar developer to meet specific requirements and submit documents detailing and minimizing any impacts associated with the project.  Specific requirements for solar projects include:

1. Glare minimization.  All panels must be constructed to minimize glare or reflection onto adjacent properties.
2. Screening.  A landscape buffer may be required if deemed necessary by the Board of Supervisors.
3. Fencing.  A security fence must be installed along all exterior sides of the solar project.
4. Setbacks.  All structures (including solar arrays) must meet the minimum principal setback for the zoning district the project is located in.

Documents required of the solar developer by Linn County include:

1. Road condition survey.  The applicant will be required to conduct a preconstruction survey detailing the condition of the roads which will be used during the course of the project.  The applicant will be responsible for on-going road maintenance and dust control measures during construction.  Additionally, the applicant will be responsible for repair of any damage to public drainage systems.
2. Operation and maintenance plan.  The applicant will be required to submit a plan for the operation and maintenance of the solar installation, which shall include measures for maintaining safe access to the installation, storm water and erosion controls, as well as general procedures for operation and maintenance of the installation.
3. Decommissioning and site reclamation plan.  The applicant will be required to submit a plan detailing how the solar arrays will be removed and recycled, as well as how they will restore the site to pre-project conditions.

5. What happens when the solar project is complete?

Most utility scale solar projects last for 25-30 years, which is the average lifespan of a solar panel.  At the end of a utility scale solar project in Linn County, the applicant will required to follow their approved decommissioning plan. All decommissioning plans must include details on:

1. Recycling solar components.
2. Restoring the surface grade a soil profile of the site to pre-construction condition.
3. Removal of all structures including graveled areas and access roads.
4. Re-vegetation of restored soil areas with crops, native seed mixes, native tree species, and plant species suitable to the area.
5. A method for ensuring funds will be available for decommissioning activities.

The decommissioning plan will take effect at the end of the project or following a continuous one-year period with no electricity generation.  The project owner will have one year to complete all decommissioning activities.

6. What is consumer-scale solar?

Consumer-scale solar is defined in Linn County as a solar panel or array mounted on a building, pole or rack that is accessory to the primary use of the parcel on which it is located and which is directly connected to or designed to serve the energy needs of the primary use. When electricity is produced at or near the point where it is used it can be referred to as Distributed Generation. Distributed solar energy is typically located on rooftops or ground-mounted, and usually connected to the local utility grid.

1. How do I find out who owns a certain property in Linn County?

There are several ways to find out who owns property. Current ownership records are maintained by the County Auditor’s Office and can be viewed online. You will need to know the address for the property, its Geo-Parcel Number (GPN), or its legal description. You may also call the Auditor’s Office at 319-892-5300. Ownership records are a matter of public information. Offices are located in the Jean Oxley Public Service Center, 935 Second Street SW in Cedar Rapids. The Auditor’s Office is located on the 2nd floor; Planning and Development is on the 1st floor.

2. What is the "farm exemption" and what qualifies for the exemption?

The State of Iowa has given counties the authority to adopt building codes for their unincorporated areas. However, the State has declared that farms should be able to operate relatively free from local restrictions. This "right to farm" is contained in the following section from the Code of Iowa:

331.304.3.b Farms exempt. A county building code shall not apply to farm houses or other farm buildings which are primarily adapted for use for agricultural purposes, while so used or under construction for that use.

Even though the State exempts farms from building regulations, it has provided few guidelines as to what should be considered a farm. In order to qualify under the agricultural exemption, it must be clearly demonstrated that the principal use of the land and the proposed building(s) is farm-related. This includes proposed dwellings, and that the occupants of the dwelling are primarily engaged in agriculture.

We strongly encourage anyone wishing to claim the exemption - especially for a new house - to contact us prior to the start of construction to determine if the exemption is appropriate. The farm exemption applies only to Linn County zoning and building regulations. Other permits (such as floodplain development, well, septic, E911 address or driveway access) may be required. 11. Can I build a garage or shed on my property in rural Linn County?

Garages and sheds are considered accessory structures on property zoned for residential use. Accessory structures can be built on property that has a principal permitted use (house). The garage must maintain all required setbacks and typically cannot be located closer to the road than the principal permitted structure. Any garage or shed over 120 square feet requires building permits, please see Residential Guidelines for Attached Garages and/or Residential Guidelines for Detached Garages. 13. Who do I ask about my subdivision covenants?

Original covenants are recorded with the subdivision plat. Iowa Code states covenants are effective for 21 years. They automatically sunset unless renewed by the homeowners or their representatives. There is a process to amend covenants. Any amended covenants are recorded with the Recorder’s Office under the subdivision name.

14. What are the regulations for putting a mobile or manufactured home on my property in rural Linn County?

Please be aware that a mobile home and a manufactured home have different definitions and are subject to different zoning regulations. In general, a manufactured home is one that was built after June 15, 1976 in compliance with federal standards. A manufactured home will bear a "HUD seal" (Housing and Urban Development) certifying that it is in compliance with the National Manufactured Home Construction and Safety Standards Act of 1974. A manufactured home is considered a single family dwelling, and any single family dwelling must meet the following requirements: a. Have a minimum width dimension of twenty-two (22) feet for its main body; b. Have continuous and complete foundation and footing for its main body; c. Have for the exterior wall covering either: Wood or masonry finish, or the appearance thereof; and/or Vertical or horizontal grooved siding or lap siding or the appearance thereof. A mobile home is not considered a manufactured home by definition, and is only permitted in a mobile home park.

1. What can I do to protect myself from mosquitoes and the West Nile Virus?

West Nile Virus (wnv) and Mosquito control
WNV is usually spread through the bites from infected mosquitoes.

Mosquitoes pick up the virus from birds that are infected with WNV.

Symptoms of WNV are often so mild, many people who contract WNV never know it and recover fully from it.

Severe WNV infections may include symptoms such as a high fever, headaches, muscle aches, weakness, seizures, paralysis and/or result in death. These infections are rare.

Those at the greatest risk for WNV include people age 50 and older and immuno-compromised individuals.

Mosquito breeding areas may include bird-baths, flower pots, used tires, floodwater areas, clogged storm drains, gutters, marshes, non-chlorinated backyard pools and other areas susceptible to water collection.

When symptoms occur, it is usually within 3 to 15 days after the mosquito bite.

You can help control the mosquito population and prevent WNV by following these simple steps:

Remove old tires, and buckets from your yard
Change the water in birdbaths and pet dishes every 3 days
Avoid over-watering flower pots and gardens
Clean gutters regularly
Keep pools chlorinated and cover them when possible
Repair holes that cause puddles in driveways and yards
Apply 30 % DEET repellent when outdoors – Use no more than 10% DEET on children
Wear baggy or loose-fitting clothing when outdoors
Repair holes in door and window screens
Avoid outdoor activities between dusk and dawn
Replace outdoor lights with yellow “bug” lights and avoid using bug zappers--they attract more mosquitoes than they kill

Yes, you are still considered a close contact even if you were wearing a mask while you were around someone with COVID-19. Masks are meant to protect other people in case you are infected, and not to protect you from becoming infected.

For COVID-19, a close contact is anyone who was within 6 feet of an infected person for a total of 15 minutes or more. An infected person can spread COVID-19 starting 48 hours (or 2 days) before the person has any symptoms or tests positive for COVID-19.

3. If I am a close contact, should I be tested for COVID-19?

If you have been in close contact with someone who has COVID-19 you should follow CDC's quarantine guidance and get tested on Day 5, if possible.

4. I was recently around someone who has COVID-19, but I feel fine. Why should I stay home?

People with COVID-19 can still spread the virus even if they don’t have any symptoms. If you were around someone who had COVID-19, it is critical that you follow CDC's quarantine guidance and get tested on Day 5, if possible.

5. What if I have been around someone who was identified as a close contact?

If you have been around someone who was identified as a close contact to a person with COVID-19, closely monitor yourself for any symptoms of COVID-19. You do not need to self-quarantine unless you develop symptoms or if the person identified as a close contact develops COVID-19.

Local vaccine providers are working to make sure you receive your vaccine and will be patient in this process. A scammer may not be! Local vaccine providers are reaching out to patients in multiple ways. This includes by mail, phone, text, email, or messaging such as MyChart to offer appointments. 

Vaccine providers will:   

• verify your age and date of birth
• ask for your Medicare number, if applicable
• ask for insurance information
• NEVER ask for your credit card number or bank information. (*Vaccinations are free. If you receive an offer to sell you one, it is not legitimate).  
• NEVER ask you for your immigration status.

It is possible a vaccine provider will need to verify your social security number, leave a message, or send an email asking you to contact them. 

 Avoiding Scams: Dos 

• Do consult with your provider or Linn County Public Health to learn up-to-date vaccine distribution channels and only receive information from valid sources like the CDC and FDA. 
• Do be cautious when clicking links you receive in text messages or email messages. 
• Do hang up the phone if you are suspicious the person on the other end is facilitating a scam. 
• Do hang up immediately if you receive a request to take a survey and it asks for personal information.
• Do contact your local law enforcement agency and your County Health Department if you feel you are the victim of a scam related to COVID-19 vaccinations.  
• Do be aware of active scams. The FBI has warned the public to be aware of activities that indicate fraudulent activity. Learn more.
• There have been reports of attempts to sell an appointment or an expedited placement to receive a vaccination. 
• There have been reports of individuals being called to schedule appointments for their vaccination. While physician’s offices do call their patients to schedule these appointments, they do not regularly ask for personal information such as Social Security numbers or payment information, such as credit card numbers. *If one doubts that these calls are genuine, hang up and call your physician’s office to confirm the appointment.  
• Some individuals have attempted to sell vaccine vials or individual shots. These persons are not reputable, and you should never buy anything from an offer like this. Any shot you receive under these circumstances is highly suspect.  
• There have been efforts by individuals to sell vaccination cards to people who are not yet vaccinated or who are vaccine-hesitant. If you receive a call like this, it is a hoax.
• There have been reports of individuals receiving calls asking them to participate in a survey related to their COVID-19 vaccination experience, with requests for personal information such as Social Security numbers. Legitimate surveyors will never ask for personal identifiers, such as Social Security numbers.    

Avoiding Scams: Don’ts    

• Don’t share personal or financial information if someone solicits you via phone, text, email, social media, or comes to your door promising access to the vaccine for a fee. You can’t pay to put your name on a list to get the vaccine or pay to get early access to a vaccine.
• Don’t open an email attachment if you are not sure what it is. 
• Don’t accept a vaccination from an organization or individual who is not part of a legitimate vaccination program. (*Consult the Health Department in the county where you live to verify the legitimacy of any vaccine provider.)

Contact our office at (319) 892-6000 to request a septic and well review. Our staff will conduct tests on the systems and provide a report that states the reliability and safety of the systems. A well water analysis can also be conducted.

2. My business needs to install equipment that requires venting. Do I need a permit for my air exhaust?

Public Health, fire or building and zoning departments may require permits. Any process creating or venting an air contaminate should be considered for a permit from Public Health. Contaminates include both particles and gases. There are a number of exemptions such as mobile sources, residential heating, lab vents, and similar small sources that aren’t associated with any production or manufacturing. Please refer to our code section 10.5 “Locally Required Permits”. If you are unsure as to the need for an air permit, the best answer is to contact our office by telephone at (319) 892-6000. Someone in the Air Quality section will be able to assess your need regarding the permit requirements

3. How would my child become lead poisoned?

The number one cause of children becoming lead poisoned is deteriorating lead-based paint found in older homes. Lead dust is also a concern when you have lead-based paint on surfaces that are chewable or that undergo friction or impact. The only way to know whether your child is lead poisoned is through a blood lead test.

4. Where can I get the 8-hour Lead Safe Renovation, Remodeling & Painting training?

5. What is radon?

Radon is a colorless, odorless radioactive gas present in the soil. Radon can lead to lung cancer when it gets into buildings where we breathe the radon and it's radioactive decay products.

Radon is undetectable except through specific testing. Every home in Iowa should be tested for radon. Most people start the testing process by using a do-it-yourself radon test kit. Testing for real estate transactions is a little different, call for information 1-319-892-6000 or www.lchh.org

6. Where can radon test kits be purchased?

Many local health departments as well as department stores offer radon test kits. Call 1-319-892-6000 or visit www.lchh.org for information on purchasing a kit or with any other questions about radon.

7. Can new homes be built to lessen the entry of radon into the home?

Yes! New homes can include a passive radon system that will prevent some radon from entering the home and provide infrastructure for easily and cheaply reducing radon levels further when needed. For information on new construction techniques call 1-319-892-6000 or www.lchh.org.

8. Can my work, home or school be inspected for indoor air quality (IAQ) concerns?

The State of Iowa and Linn County have implemented restrictions on burning as set out in the Air Quality State Implementation Plan.

10. Where can I get my child tested for lead poisoning

Public Health - Open Burning

1. How do I know if I am allowed to apply for an Open Burn Permit?

Enter the address where the burn will occur into the Linn County online Open Burn Permit Application Tool (https://lcgis.linncounty.org/apps/health/openburning/).  The Tool will evaluate the address and determine whether the property is outside of the established "no burn" areas.  If burning is allowed, you then have the option of applying for an Open Burn Permit for that property.  Alternatively, you may call Linn County Public Health at (319) 892-6000 and ask for assistance. 

2. How long do Open Burn Permits last?

Typically, Open Burn Permits are valid for 12 months following the issuance date.  Permits granted for training fires or prairie burns may only be valid for 30 days.  Please check the expiration date on your issued Open Burn Permit to verify the expiration date. 

3. How much do Open Burn Permits cost?

All Open Burning Permits cost $25.  Payments can be made in-person or over the phone via credit card (fees apply).  Payment is expected prior to issuance of the permit. 

4. I've lost my Open Burn Permit. How can I recover it?

5. What is the difference between Landscape Waste and Tree Trimmings?

When applying for an Open Burn Permit, you will be expected to disclose what materials will be burned.  There is some overlap in the categories offered in the application process and we understand that these categories may cause confusion.  If you have any questions regarding the appropriate category to select when applying for an open Burn Permit, please contact Linn County Public Health. 

The "Landscape Wastes" category includes grass, leaves, weeds, trees, tree limbs, and other natural growth and agricultural wastes.  In most circumstances, this specifically applies to trees and tree limbs originating on the property where the burn will take place and is appropriate for most residents of Linn County.

The "Tree and Tree Trimmings" category is specifically for the burning of trees and tree trimmings not originating on the premises for a burning site operated by a local government entity.  This category is not appropriate for most residents of Linn County with the goal of burning trees, leaves, and tree limbs. 

6. What materials can I legally burn with an Open Burn Permit?

Linn County Code of Ordinances Section 10-63 (https://library.municode.com/ia/linn_county/codes/code_of_ordinances?nodeId=PTICOOR_CH10EN_ARTIIIAIQU_S10-63OPBU) itemizes the materials that may be burned legally and the limitations that surround how those materials may be burned. Most Open Burn Permits are issued for "Landscape Wastes," which include grass, leaves, weeds, trees, tree limbs, natural growth for land clearing, and agricultural wastes. Permits are also allowed for disaster rubbish, ceremonial burning, agricultural structures, training fires, and other approved reasons. All permit holders are expected to follow the limitations itemized in their permit and in accordance with the Linn County Code of Ordinances.

No, wills are generally filed at the Clerk of District Court's office. Very few wills are recorded in the public record at the Recorder's Office.

3. Can the Recorder's Office verify information via telephone regarding birth, death and/or marriage records ?

No. Records are available for review in person, but information regarding births, deaths and marriages cannot be given over the telephone.

Officiants shall be ordained in the state of Iowa to perform marriage ceremonies. Visit IDPH for Officiant Brochure requirements. Proof of registration is not required when applying for a marriage application.

5. What is the fee for a certified copy of a birth, death or marriage record?

You must have a credit card in your name with the same address. The fee is more for this service than if you order in person at the county registrar's office.

10. When completing the marriage license application, can the Notary Public be a family member of one of the people filling out the application?

No. Each party to the marriage application must sign the application in front of an authorized Notary Public who is not a family member. The Linn County Recorder's Office has authorized Notary Publics on staff.

Linn County is self-insured for workers’ compensation, auto liability and general liability. Linn County also carries commercial property and flood insurance policies through national carriers.

Sheriff's Office - Foreclosure Sales

1. Can I enter a residence before purchasing it?

No, if the residence is unoccupied.

2. Does the Sheriff's Office have keys to the residence?

The Sheriff's Office does not have keys to any residence and cannot give permission to enter a residence.

3. How does the bidding process start?

The judgment holder almost always starts the bidding.  Generally, the judgment holder bids in writing a plaintiff’s bid on judgment.  This bid is usually given to the Sheriff before the day of the sale.  The judgment holder’s bid, if given to the Sheriff prior to the sale, is considered a sealed bid and will not be disclosed until the sale is called.

4. Do I have to pay my bid in full on the day of purchase?

Yes.

5. How do I pay for the purchase of a Sheriff's sale?

You may “hold” your bid by writing a personal check for the full amount you bid to the Linn County Sheriff if it is accompanied by a letter of guarantee from the bank you are writing the check on.  Depending on where you bank, you will be given enough time to go to your bank and get a cashier’s check for the full amount you bid and return it to the Linn County Sheriff's Office.  At that time you will receive back your personal check.  In any event, this transaction must be completed by noon on the day of the sale.  Another possibility is; if you know the maximum you are going to bid, you may have a cashier’s check already made out to the Linn County Sheriff for that amount.  If your actual bid is less than that, you will be refunded the difference.

6. What if I'm the highest bidder, but change my mind about buying the property?

Pursuant to Iowa Code 626.85, the judgment holder may proceed against you for the amount you bid.  If the judgment holder does not wish to proceed against you, the sale will be treated as a nullity and the Sheriff will then proceed as mandated by the Code of Iowa.

8. Who is responsible for back property taxes?

Taxes stay with the property. If you purchase a property, you are now responsible for the taxes.

9. If I purchase a property with a redemption period, when will I receive the Sheriff's deed?

If you purchase property with a redemption period, you will be issued a certificate of purchase.  When the redemption period is up, you may then return the original certificate of purchase to the sheriff and you will then receive a Sheriff’s deed.  It is very important that you do not lose the original certificate of purchase.  If you lose it, you will not receive a Sheriff’s deed until you get a court order directing the Sheriff to issue you a duplicate certificate of purchase. (Iowa Code 626.96) If you fail to have a Sheriff’s deed issued within 8 years after the date of issuance of the certificate of purchase, the Sheriff’s sale will be cancelled. (Iowa Code 626.97)

Treasurer - Motor Vehicle

1. How do I renew my driver's license?

Your Iowa Driver's License is issued through the Iowa DOT. Please call 319-377-6461 with any questions regarding driver's licenses.  Their physical address is 3726 Queen Ct. SW, Cedar Rapids, IA 52404.

2. How do I get a replacement title?

Replacement titles must be obtained from the County where it was issued. All owners on the face of the title must sign for a replacement title, even if there is OR between the names. If you just made an error on your title and you need a replacement, you can surrender your title, complete an Application for Replacement Title, pay $25, and get a title the same day. If the title to your vehicle was altered, destroyed, lost, or stolen you may obtain a replacement for $25. You need to complete an Application for Replacement Title, pay $25, and after 5 days your title will be printed. If the scheduled print day falls on a weekend or holiday, your title will be printed on the next working day. You can indicate on the application if you would like the replacement title mailed to you or if you would like to come back and pick it up. The 5 day waiting period will NOT start until we receive the application for replacement title and the $25 payment. All of the vehicle information required on this form can be found on your vehicle registration. All owners on the face of the title must sign for a replacement title even if there is an OR between the names. If you have a lien on the vehicle, the lienholder may have the title. If you had a lien originally and it was paid off, please call the Treasurer’s office to see if the lien was released on our system. Please visit the Iowa DOT Personalized & Specialty Plates page to complete your order through our EASY online process. The plates will be mailed to the Treasurer's Office within 3-4 weeks. We will send you a letter when the plates are in. You will need to bring in your old plates to switch them out with the new plates.

5. How do I transfer a title?

If you purchased a vehicle, you will bring in the title, along with the supporting documents (see below) to transfer. If you are an Iowa resident and are selling a vehicle, you must have an Iowa title. If you have an out of state title, you will need to pay $25.00 to obtain the Iowa title. Seller(s) must sign and print their name of the back of the title. If the word “and” is used on the face of the title, all owners must sign. The date of sale must be entered. If the vehicle is 9 years old or newer, the seller must complete the odometer section and legend box on the title . If the vehicle is 7 years old or newer, the seller must complete the odometer and the damage disclosure section. Any alterations, erasures or cross-outs may void the title and a replacement may be required. If purchased from a dealer, a purchase agreement is required. 6. I just moved to Linn County, what should I do?

If you moved to Linn County from another county in Iowa, you can get an updated registration to reflect your current address at our office, located at 935 2nd St SW, Cedar Rapids, IA 52404. You will keep the same plates & title, but you will now renew your vehicles with us. Your plates are valid throughout the state but if you would like Linn County plates, you must surrender your old plates and pay an additional $5 fee. If you are leasing a vehicle, please contact our office at 319-892-5500 for more information. 

If you moved to Linn County from another state, you will need to bring in your driver’s license, social security number & out of state title so that we can issue an Iowa title. (If a lienholder has your title, you can bring in your out of state registration instead of your title.) Iowa law requires that you register your motor vehicle within 30 days of bringing the vehicle into Iowa. Iowa registration is required even though your plates may still be valid in another state. We will also need an application for title and/or registration signed by all owners on the title and/or registration. You can find the application at this link:

7. I just sold my vehicle, what do I do with my plates?

If you sold your vehicle & do not plan to replace it; turn your plates in within 6 months of the date of sale and we will apply for a refund of any credit, $10 or more.

If you sold your vehicle and plan to replace it within the next 6 months; you may use those plates on your next vehicle. Any credit, $10 or more, will be applied to the registration on your new vehicle.

If you have turned in your leased vehicle, you will need to fill out a Claim for Refund and a Lease Termination along with your plates. You can then apply for a refund as long as there is $10 credit or more left.

If you moved out of state, you will need to fill out a claim for refund and also send in a current copy of your out of state registration for each vehicle. You can then apply for a refund as long as there is a $10 credit or more left.

9. What if I want the new plate design?

If you want the new plate design and your current plate is not ten years old and up for replacement, you need to bring in the old plates and exchange them for the new plate design. There is a $5.00 fee to switch from your current plates to the new plate design. The plate numbers/letters would not be the same when you switch from your current plates to the new plate design. 

10. Who should I make a check or money order payable to?

11. How do I put a vehicle in storage?

The owner of a vehicle may, before the vehicle registration becomes delinquent in any year, turn in the registration plates for a vehicle to the County Treasurer of the county where the vehicle is registered. A vehicle eligible for semiannual installments may not be stored until the second semiannual installment is paid. There is no refund of registration fees when placing a vehicle in storage. You may re-register your vehicle at any time in the future with the payment of the full current annual registration fee due at that time. However, if a vehicle was placed in storage any month prior to the expiration of the registration, replacement plates must be issued and replacement plate fee paid.

Military Storage in Time of War

If the vehicle is registered for the current year and the owner has entered the military service of the United States in time of war and the vehicle has been placed in storage, a refund may be applied for on the unexpired months of the registration year by making a verbal statement. Registration plates must be turned in. Upon the owner's return to the State of Iowa, the vehicle will be registered for the remaining months of the registration year.

Tax bills are mailed out during the month of August after the Treasurer’s office receives certified taxes from the Linn County Auditor and all advance payments have been applied.

After the tax bills have been mailed out and you still do not have a bill, the Treasurer’s office can send out a replacement bill.

3. I don’t think my property is assessed correctly?

The Linn County Assessor determines property values and provides notification to property owners outside the City of Cedar Rapids. The Cedar Rapids Assessor determines property values and provides notification to property owners within the city limits. Please contact the Linn County Assessor’s Office at 319-892-5220 or the Cedar Rapids Assessor’s Office at 319-286-5888 for the latest valuation information on your property or for any questions.

4. How do I appeal my assessment?

You can appeal your assessment with the City of Cedar Rapids Assessor or you can call the at 319-286-5888 if you live within the city limits. 5. What happens at a Tax Sale?

The Annual Tax Sale is an auctioned sale of delinquent property taxes. Bidders have to pay a registration fee in order to buy properties at tax sale. They purchase the taxes for what is owing and then the hold a lien against the property. It could be for one dollar or thousands of dollars. The tax sale is every third Monday in June. There are two kinds of certificates. There is a regular certificate that is purchased the first time at tax sale. There is also a public bid (PB), taxes that are one year delinquent and no one purchased at the tax sale. Then it was offered again at the next year’s tax sale and then it was offered and purchased. If the tax sale is a regular certificate, the certificate holder has to wait a minimum of one year and nine months before they can start the process of taking deed to the property. They also have up to three years from the date that it was purchased at tax sale to start the process of taking deed to the property. If it goes past the three years since the date of purchase of the tax sale, then they can no longer take deed to the property. If the tax sale is a PB, the tax sale purchaser only has to wait nine months before starting the process of taking deed to the property. They have all the way up to three to start the process of taking deed to the property. If it goes past the three years since the date of purchase of the tax sale, then they can no longer take deed to the property Taking deed to a property by the tax sale process, it is a ninety day process. The property owner can still redeem the taxes during this time. Once the ninety days are up, the property owner will no longer be able to redeem and loses their property for the percentage of the tax sale certificate. Tax sales incur penalty or interest at 2% each month that it goes unredeemed. Once a property is at tax sale, any other delinquent subsequent taxes that still owe after Nov 15th and May 15th can be purchased by the tax sale certificate holder and added to the tax sale amount without having to wait until the 3rd Monday in June. Tax sales are redeemed with certified funds (cash, cashier’s check, or money order) and an Affidavit of Redemption of a Parcel sold for Taxes form.

6. How do I pay property taxes?

Property taxes are due in September and March of every year. You may make partial payments at any time but any remaining balance still owing after the delinquent date (October 1 and April 1) will accrue penalty at 1 ½% interest per month.

You can pay either the full year in September or just the September installment.

Only one billing is sent out for your tax bill. The tax bill has two coupons at the bottom. Each coupon is for one half of the tax bill.
If you have bought or sold property, be sure to know if the buyer or seller is responsible for paying the taxes on each parcel. This is something that would have been discussed in your closing agreement.

7. Can I pay a full year of my property taxes in September?

•You can pay either the full year in September or just the September half.
•Only one billing is sent out for your tax bill. The bottom of the tax bill has two coupons. Each coupon is for each half of the tax bill. If you do not pay the full year in September, be sure to remember you will have the second half due in the month of March.
•If the last day of either September or March falls on a weekend, you will have the following business working day to pay your taxes without penalty.

8. How do I avoid paying penalty or costs?

•Be sure to bring your tax bill with you to pay them or include the coupons if you mail your payment to the office.
•We have a secure payment box at the kiosk.
•If you've bought or sold property, be sure to know if the buyer or seller is supposed to pay the taxes on each parcel. This is something that would have been discussed in your closing agreement. Since our tax bills are only billed once a year in the month of August you will not receive a tax bill from us because it has already been sent to the previous owner.
•Keep track of a list of your parcel numbers and a list of the payments made.
•Remember that taxes can always be paid online. It only costs 30 cents to use your checking account information to pay online.

9. Does my mortgage company pay my property taxes?

The Linn County Treasurer does not keep record of mortgage companies payment responsibility and if they should be making your property tax payment. You will want to contact your mortgage company if there is any question about whether they are going to make that payment or if you need to.

10. I just bought a mobile home. What do I need to do?

A tax clearance must be obtained first in order to transfer a mobile home title. A tax clearance is issued if ownership changes or if the home is moving. A tax clearance assures that all taxes are paid before the new owner(s) title it. After the tax clearance is obtained, a title transfer can be done. All owners that are going on the new title will need to sign the Iowa Application for Title. Please see the Motor Vehicle Title section for more information on transferring a mobile home title

11. Do I have Homestead credit and/ or Military Exemption on my bill?

The homestead credits and Military Exemptions are done with the Assessor’s office. If you live inside the City Limits of Cedar Rapids, then you would want to talk with the City of Cedar Rapids Assessor ( 319-286-5888). If you live outside of Cedar Rapids, then you want to talk to the Linn County Assessor (319-892-5220). Witwer Trust Grant Program

1. What is the Witwer Trust Grant Program?

Each year, Linn County receives $80,000 from a trust established by Weaver Witwer, a prominent Cedar Rapids grocer and landowner who died in 1979. Mr. Witwer established the trust as a way to give back to the community in perpetuity. Each year, Linn County awards these funds to local non-profit organizations through a competitive grant process. The funds must be used to benefit Linn County residents.

2. How do I submit a grant application?

Applications are available online and must be submitted online via Linn County’s website at www.linncounty.org. Applications are accepted once per year from Nov. 1 through Dec. 15.

3. What is the deadline?

Applications are accepted once a year. The application cycle begins Nov. 1 of each year, and the deadline is Dec. 15. Applications must be submitted online at LinnCountyIowa.gov/Witwer. Linn County does not accept grant applications via email, fax, or paper copies.

4. I forgot my password. What should I do?

If you forgot your password, click the "Forgot Your Password" link on the sign in webpage. You will then receive an automated email with instructions. Follow the instructions you receive in the email. Linn County cannot access or reset your password.

5. Where is the Assurances form?

The Assurances form can be downloaded from the Witwer Trust grant application webpage when the grant application cycle is open (Nov. 1-Dec. 15). Scroll to the bottom of the page. There are two Assurances forms. One is for non-profits and one is for applicants using a fiscal sponsor. Please be sure to use the correct form for your organization.

6. What is the review process and timeline?

Grant applications are screened for completeness by Linn County staff. Incomplete grant applications and applications that do not meet eligibility criteria or guidelines are ineligible for grant funds and will not be reviewed. Complete grant applications and those meeting the grant eligibility criteria and guidelines are reviewed and evaluated by the Linn County Board of Supervisors. Funding decisions are made in February.

7. How much funding is available?

The total amount of funding available for all grant applicants is $80,000. There is no cap for grant requests. However, please use common sense in making your requests. Approximately 50-60 applications are received each year totaling more than $200,000. Please keep this in mind as you develop your budget and grant request. The Linn County Board of Supervisors Witwer Trust Grant Program receives more funding requests than it can possibly grant. If support of a worthwhile program is declined, this decision does not reflect on the value of the group or service, but rather on the need to be selective because resources are limited. 8. Are matching funds required?

Matching funds are not required, but you should show the full cost of your project and other sources of funds.

9. Who is eligible for Witwer Trust grants?

Witwer Trust grants will be made only to non-profit organizations that are located in Linn County, Iowa or that have a branch location in Linn County and whose work benefits Linn County residents. Proof of non-profit status is required. Grant funds must be used for programs or projects that benefit Linn County residents. Applicants who have not submitted the required final report for previous Witwer Trust grants are not eligible for funding. Due to legal restrictions, Iowa Code Section 331.901(5), organizations under ecclesiastical or sectarian management are not eligible for Linn County grant funds.

10. What types of projects are eligible for grant funds?

Grant funds must be used for programs or projects that benefit Linn County residents. Priority is given to requests for programmatic and capital projects over requests for operating support. Grants must be for expenses that have not yet been incurred. A list of previously funded projects is available at www.LinnCountyIowa.gov/Witwer.

11. How do I create an account?

You can submit a Witwer Trust grant application without creating an account; however, this method requires you to complete your application in one sitting.  To save your work and come back at a later time, you must create an account and be signed in to save your work.

12. May I submit more than one proposal?

No. Only one application is allowed per organization. If an organization submits more than one grant application, all applications submitted by that organization will be deemed ineligible for grant funds and will not be reviewed. Only one project is allowed per application.

13. May I submit more than one project in one proposal?

No. Only one proposal is allowed per organization, and only one project is allowed per proposal. If an organization submits a proposal requesting funding for more than one project, the proposal will be deemed ineligible and will not be reviewed.

14. Can I apply to the Witwer Trust if I received grant funding from the Linn County Historic Preservation Grant Program for the same project?

No. An organization cannot receive funding for the same project from both the Witwer Trust and the Linn County Historic Preservation Grant Program.

15. What is the Linn County Historic Preservation Grant Program?

This is a competitive grant program for non-profit organizations in Linn County to be used for historic preservation projects. Eligible projects include collecting and preserving historical materials, artifacts, places, or structures; maintaining a historical library or collection; conducting historical studies or research; issuing publications; providing public lectures of historical interest; or otherwise disseminating a knowledge of the history of the area to the general public. 16. Can my organization apply for a Witwer Trust grant AND serve as a fiscal sponsor for a different organization?

1. What permits are required to build a house in Linn County?

Separate zoning, building, electrical, mechanical and plumbing permits are required. Application for a building permit includes the submittal of two sets of construction drawings. In order to determine a valuation and permit fee, please include the area in square feet for: each floor, finished basement, unfinished basement, garage, decks and porches. Plans are thoroughly reviewed by an inspector for code compliance before issuance of the building permit. electrical, mechanical and plumbing permits must be obtained and work performed by contractors licensed in the respective trade.  For further information view our Single Family Dwelling Handout. Before the above permits can be issued, the Planning & Zoning Division must verify that all zoning requirements are met and must also approve a site plan. You will need to provide staff with the locations of the well, septic drainage field and existing structures. You will also need to provide the location of the proposed improvement showing dimensions from property lines and from existing structures. Contact the Linn County Planning and Development Department for information on required submittals for constructing a new house or garage at 319-892-5130. Contact the Public Health Department at 319-892-6000 for information on well and septic system permits and the Linn County Engineer at 319-892-6400 for information on a driveway entrance permits and addressing permits.

2. What is the "farm exemption" and what qualifies for the exemption?

The State of Iowa has given counties the authority to develop zoning regulations for their unincorporated areas. However, the State has declared that farms should be able to operate relatively free from local restrictions. This "right to farm" is contained in the following section from the Code of Iowa:

335.2 Farms exempt. Except to the extent required to implement section 335.27, no ordinance adopted under this chapter applies to land, farm houses, farm barns, farm outbuildings or other buildings or structures which are primarily adapted, by reason of nature and area, for use for agricultural purposes, while so used. However, the ordinances may apply to any structure, building, dam, obstruction, deposit or excavation in or on the flood plains of any river or stream.

Even though the State exempts farms from zoning regulations, it has provided few guidelines as to what should be considered a farm. In order to qualify under the agricultural exemption, it must be clearly demonstrated that the principal use of the land and the proposed building(s) is farm-related. This includes proposed dwellings, and that the occupants of the dwelling are primarily engaged in agriculture.

We strongly encourage anyone wishing to claim the exemption - especially for a new house - to contact us prior to the start of construction to determine if the exemption is appropriate. The farm exemption applies only to Linn County zoning and building regulations. Other permits (such as floodplain development, well, septic, E911 address or driveway access) may be required. Please contact the appropriate county department for information.

New in 2020!

In 2020, the Iowa legislature enacted additional exemptions from zoning regulations for “agricultural experiences” as follows:

335.26 Agricultural experiences exempt. To assist in the promotion of agricultural experiences, a county shall not require a conditional use permit, special use permit, special exception, or variance for agricultural experiences on property of which the primary use is agricultural production. Agricultural experiences includes any agriculture-related activity, as a secondary use in conjunction with agricultural production, on a farm which activity is open to the public with the intended purpose of promoting or educating the public about agriculture, agricultural practices, agricultural activities, or agricultural products.

Because the “agricultural experiences” provision in state code is new, the definition of an agricultural experience is very broad, and the application of building codes is not exempted, please contact the Planning & Development Department for assistance.

3. Is there a deadline for submitting my application for next month's agenda?

Yes, there is an application deadline, which is the last day you can submit a case for the next month’s case cycle. Case types that are required to meet the application deadline include: rezoning, residential parcel split, land preservation parcel split, final plat, conditional use, special exception, and variance. The application deadline is normally the 3rd Wednesday of the month. 5. How do I find out what the current zoning is for a certain property in Linn County?

Current zoning maps can be found at the Linn County Online Mapping site. Click accept if prompted (you may need to download Adobe Flash). Type in the parcel address or Geo-Parcel Number (GPN). The zoning district legend can be found by selecting “Layers” at the top right of the page, then selecting the drop-down menu for “Zoning.” If the zoning doesn't appear, you may need to zoom in.  If you have any questions, call 319-892-5130 for assistance.

6. Can I operate a business from my home in Linn County?

It is possible to operate a business from your home if the business meets certain criteria. A permit is required if any of the following are true of your business: has non-resident employees, has more than five customer visits in one day or more than three at once, has commercial vehicles or business equipment parked outside all or a portion of an accessory building is being used for the business. Please contact the Planning and Development Staff to determine whether your particular business will require a permit. Home occupations requiring a permit are granted by the Linn County Board of Adjustment after review and recommendation by the Planning and Zoning Commission. The regulations in the Unified Development Code governing Home Occupations is Article VI, Section 107-113(h).

7. What are the required lot sizes and setbacks?

Required lot sizes and setbacks vary depending on the zoning district of the property. First, you will need to determine the zoning district for the property in question (see item #5 in this FAQ). Next, you can locate requirements for the applicable zoning district in Article VII of the Linn County Unified Development Code.  

A setback is defined by the Unified Development Code as “the minimum horizontal distance between a lot line and a building or structure located upon such lot required by the provisions of this chapter.” In order to know the distances from the proposed structure or addition to the lot lines, you will need to determine where the relevant property lines are located. If your property has been surveyed or is a platted lot, survey pins should be located at the corners of your property. If there are no property pins, or you are unsure of their location, these Tips for Locating Your Property Lines may be of assistance. There may also be easements located on the property that may have restrictions.

8. What is the status of my Linn County zoning case?

The best way to find information on the status of a case is to contact the lead staff person listed on your staff report. You can also email Linn County Planning & Development or call 319-892-5130. 

9. My property is subject to deed restrictions (covenants). What are they and does Linn County enforce them?

The Iowa Land Use Planning Notebook defines a Deed Restriction (Covenant) as follows:

"A private legal restriction on the use of land, attached in the deed to a property. A deed restriction is most commonly used in the establishment of a subdivision to restrict the use of all individual lots in the development to a certain type of use, e.g., single-family dwellings. Usually the community has no control over deed restrictions." (Source: Huntington, Stuart. Iowa Land Use Planning Notebook, Glossary of common planning and zoning terms. Deed restrictions may also restrict the type of construction materials, the minimum finished floor area, and may even require review and approval of building plans by an "architectural control committee." Deed restrictions, also called restrictive covenants, are private controls and the county has no authority to enforce such restrictions. Enforcement is therefore a civil matter between owners within the subdivision.

10. What do I need to do to divide my property in rural Linn County?

The Linn County Unified Development Code regulates the division of land. Any parcel of ground created that is less than thirty-five acres in size must submit an application for subdivision with the Linn County Department of Planning and Development. Depending on the use of the property (proposed or current) you may also need to rezone your property. Rezoning may be required when a property is being subdivided, resulting in any lot of less than 35 acres of land. A rezoning or subdivision request must meet the required minimum levels of service (MLS) and have a passing Land Evaluation Site Assessment (LESA) score calculated for the property. There are different MLS requirements for different land use designations on the Linn County Land Use Plan Map; however, they are all required to be within 1/4 miles of a county maintained hard service surfaced road. Separation requirements from Confined Animal Feeding Operations, as well as minimum distances to a fire station must also be met. Minimum levels of service are items that must be met and no variances are allowed. Email the staff at Linn County Planning and Development or call 319-892-5130 with any questions.

11. Can I separate the original farmhouse from the farm?

Linn County allows two different types of parcel splits to separate a house from a parent parcel.  There are several factors in determining which type of split a parcel would qualify for, including what year the house was originally constructed. These two processes are called Residential Parcel Splits and Land Preservation Parcel Splits. Requirements for both types of subdivisions can be found in Article IV of the Linn County Unified Development Code. 12. How can I find out if my property has a mapped FEMA floodplain on it?

The Linn County Geographic Information System Division maintains an interactive Flood Hazard Map.  Enter your address or GPN in the upper left-hand corner of the interactive map to search for your property.  If you need help interpreting the map, or for any other Flood Hazard Map questions, please email our Certified Flood Plain Manager or call 319-892-5130.

13. How do I get an elevation certificate for my house or proof that my house is not located in a floodplain?

Planning and Development staff may have an elevation certificate they can provide you with.  If Planning and Development staff does not have an elevation certificate for your property, you will need to contact a licensed surveyor to complete one for you.
